General Contract Conditions for Advisory and Planning Services

These General Contract Conditions (the "Conditions") shall expressly govern the business relationship between IKEA IBÉRICA, S.A.U. ("IKEA"), with tax ID A-28812618 and registered address at  Avenida Matapiñonera, 9, 28703, San Sebastián de los Reyes (Madrid, Spain), and the users or customers (the "Customer") who purchase the advisor service for kitchens, bathrooms, living rooms, bedrooms (including for children and teenagers) or workspaces, whether in store, remotely (via the IKEA website) or at home (hereinafter referred to jointly as the "Service").

  1. PRE-CONTRACTUAL INFORMATION AND STATEMENTS

 

  • IKEA hereby states that this Service is for Customers who will use the IKEA products for domestic purposes and, in any case, completely separately from their business and/or professional activities.
  • Use of this Service implies that the Customer fully and unreservedly accepts the following Conditions in their entirety, as well as the IKEA website terms of use and the IKEA Privacy Policy in effect at any given time, which are available at https://www.ikea.com/es/en/customer-service/privacy-policy/ 
  • The Customer, prior to entering into the contract and during the purchase process, may access, save and print these Conditions for their reference.
  • All information and personal data provided by the Customer shall be handled in accordance with the IKEA Privacy Policy, following the data processing procedures specified in these Conditions and in line with the options selected by the Customer at the time of accepting these Conditions. The Customer declares that all information and data that they provide to IKEA is truthful and reflects their actual situation. If the Customer does not provide all the required information, their appointment with an advisor will not be possible.
  • The Customer undertakes not to carry out any false or fraudulent planning, and IKEA reserves, in those circumstances, the right to cancel it and take appropriate action.
  • The Customer declares to be over eighteen (18) years of age and to have the necessary and sufficient legal capacity and ability to enter into financial contracts.
  • The Customer is hereby informed that the Service provided by IKEA under no circumstances implies physical modifications to the property. Rather, they are simply suggestions for decoration. The Customer guarantees that the room(s) in the property for which they are purchasing the Service is/are located within Spain's national territory on the Iberian Peninsula and, if this is not the case, accepts liability for any prejudice caused to IKEA as a result of failure to comply with this guarantee.
  • The Customer purchases this Service in their capacity as the user, holder or tenant of, or any other position that entitles them to inhabit and/or exercise professional activity in, the property specified above, and exempts IKEA  from any third-party claims resulting from any breach in that regard.

 

2. IKEA PRODUCTS.

  • The Customer acknowledges that all products sold by IKEA are intended for domestic use and have been subjected to testing methods in accordance with relevant regulations and standards. However, some items in the range have been tested for professional or public use and meet the safety, durability and stability requirements established by the technical standards corresponding to such uses.
  • The guarantees offered by IKEA on all its products generally cover their household use. Before purchasing an IKEA item, the Customer must make sure that it is suitable for the use that they intend. For this purpose, product fact sheets are available to consult at IKEA stores and at www.IKEA.es/en.
  • IKEA accepts no liability for any claims arising from a use different from that for which the IKEA item is designed. 
  • The Customer states that they are aware that IKEA does not have management systems certified in accordance with international standards (ISO 9000, ISO 14000, EMAS, SA8000, etc.) IKEA aims for the IKEA brand to be a trustworthy guarantee for its Customers in its own right, both with regard to the processes that it uses and the items that it sells, in terms of quality, safety, the environment and corporate responsibility. To do this, it has management systems and internal protocols covering all its processes, which are internally audited to ensure that they are carried out correctly in all IKEA units.
  • The manufacture of its products is subject to IKEA standards of quality, environment and corporate responsibility, based on international principles shared by regulations and established under the standards such as those mentioned above. In addition, internal auditors continuously verify with all product and service suppliers for IKEA that they are operating correctly.

 

3. CONDITIONS FOR PROVIDING THE SERVICE.

  • IKEA hereby states that the Service does not include anything besides a consultation for the design and decoration of the specified room (kitchen, bathroom, living room or bedroom – including for children and teenagers – and workspaces). The products and additional services must be purchased and paid for at the time that they are acquired, whether in store or remotely; under no circumstances will they form part of the Service.
  • In the case of the kitchen advisor service, the Customer declares that living area of the room, its space and physical layout, are in their final condition. This includes, where appropriate, water and light fixtures being in their final location, and floors and walls having their final finishes.
  • IKEA will not provide the Service on the basis of non-IKEA products being used.
  • Products included in plans or quotes, or that are discussed during the consultation, do not form part of the Service and, therefore, may only be purchased in accordance with the usual purchasing system, at the price and under the conditions listed on the date on which the purchase of each product is made, including in cases where the product quotes provided during the consultation stipulate different conditions. Likewise, the Service does not include any delivery, assembly or other additional service that is not expressly referred to in these Conditions. 
  • As an essential condition for providing the Service, the Customer exempts IKEA from any liability and, therefore, will be solely responsible for taking into consideration and making use of the products in accordance with the corresponding technical specifications and instructions for use; as well as for verifying the correct location and placement of the product in the property, in accordance with the building book, the obligations for use and maintenance of the property, emergency and evacuation manuals and any other requirements that may emanate from the manuals and regulations that are applicable to the property in question, of which IKEA has no knowledge and for which the Customer will be solely responsible. 
  • In light of the foregoing, it shall be solely the Customer's responsibility to verify that the design and documentation generated by IKEA meets the conditions of safety, habitability, suitability and other obligations that in their capacity as user, owner, tenant or any other title granting them the legitimacy to provide this service in relation to the property, or if it must be amended by the Customer.
  • Accordingly, the advising provided under this Service is of an informative nature and under no circumstances may the inability of any kind (material, legal, financial, administrative, etc.) to bring the project resulting from the service to physical fruition be considered attributable to IKEA, with IKEA being completely exempt from any kind of liability in this regard.
  • For the proper provision of the Service, it is essential that the Customer provides the measurements of the room to which the IKEA advising relates; the Customer may add any information or graphic elements regarding the room (plans, images, etc.), which IKEA, at its sole discretion, may take into consideration or disregard. In the event of discrepancy between the documents provided by the Customer, the measurements will always take precedence; no other documents shall be binding on IKEA.The Customer assumes responsibility for any figures, measurements, descriptions, images, plans and information, etc. contained in the documents provided, and exempts IKEA from any liability in the event that any part of the information provided does not correspond to the physical reality (measurements, plans, spaces, layouts, etc.) of the room, including if said document was disregarded by IKEA.
  • If any case of force majeure or a circumstance attributable to the Customer arises that prevents any of the obligations assumed by IKEA for this Service from being fulfilled, this shall not imply non-compliance by IKEA nor invoke its liability or lead to an additional obligation on its part.Likewise, if any case of force majeure or a circumstance attributable to IKEA arises that prevents any of the obligations assumed by the Customer from being fulfilled, this shall not imply non-compliance by the Customer nor invoke its liability or lead to an additional obligation on their part.
  • All information that is provided by the Customer shall become the property of IKEA, with IKEA not being liable in any way for the veracity, precision, exactness or sufficiency of the information exchanged between the Parties.
  • It is possible that a product that IKEA confirms as being available at the time of the order may run out of stock. If this happens, IKEA shall inform the Customer via email and/or by phone within a minimum of forty-eight (48) hours prior to the delivery of the products, and will offer the Customer one of the following alternatives: (i) delivery of the product later than the date initially indicated; (ii) replacement of the product for a similar one in terms of characteristics, functions, quality and price; and/or (iii) refund of the price paid within a maximum of seven (7) calendar days of the Customer indicating that this is their chosen alternative.

 

4. SERVICE DESCRIPTION.

A) IN-STORE OR REMOTE ADVISING.

  • IKEA shall provide the Service in store or remotely for the purchase of kitchens, bathrooms, living rooms, bedrooms (including for children and teenagers) and workspaces, and the Service will include the design and planning of the corresponding room by IKEA based on (i) the information provided in the questionnaire that the Customer is to complete during the appointment booking process; and (ii) the measurements provided by the Customer. The information and measurements are both vital for the proper provision of the Service. 
  • IKEA shall send the Customer automatic confirmation of the specific time and date that the Service will be provided.
  • The Customer must send IKEA the measurements of the area that is the subject of the consultation using the address provided by IKEA prior to the appointment.
  • The Service is provided on a one-time basis in a single session, in store or remotely, on the date and by the means agreed upon by both Parties, with a maximum duration – based on the type of appointment and the Customer's consultation needs, depending on the room – of (i) ninety (90) minutes for kitchens; (ii) forty-five (45) minutes for bathrooms and workspaces; and (iii) thirty-five (35) minutes for living rooms and bedrooms. This is unless otherwise agreed with the Customer beforehand.
  • IKEA shall provide the Customer, within a maximum of two (2) days, with a 3D blueprint and a quote, both in .pdf format, the delivery of which shall exempt IKEA from any other obligations or responsibilities. The design will be used as a base to prepare the quote that will be provided to the Customer, and will contain items and products, and their corresponding prices, based on the criteria chosen (model, colour and sizes, etc.). This quote will be valid for thirty (30) calendar days.
  • For this Service, IKEA also offers the Customer the possibility of requesting assistance, by means of the verification service, in taking measurements, which may be added for a fixed amount of forty euro (EUR 40), regardless of whether the customer ultimately buys the products for the room at IKEA. Nevertheless, if the Customer ultimately acquires the products for the room at IKEA, following the purchase of the planning service, this amount will be deducted from the price of the products. Verification will be mandatory in two cases: (i) for kitchen installations; and (ii) when sliding doors are to be installed on SKYTTA wardrobes.
  • If kitchen installation is purchased from a partner company, whether external or internal to IKEA (depending on the IKEA store responsible for the service), said company will verify the kitchen prior to installation – a process unrelated to IKEA – in order to verify that the design is correctly adapted to the Customer's kitchen.
  • Once the verification service has been completed, the Customer must sign a document stating their approval.

B) AT-HOME ADVISING.

  • Subject to the availability of the Service, depending on the IKEA store responsible, IKEA shall provide the Service at home for the purchase of kitchens, living rooms and bedrooms (excluding bedrooms for children and teenagers), and the Service will include the design and planning of the corresponding room by IKEA based on (i) the information provided in the questionnaire that the Customer is to complete during the appointment booking process; and (ii) the measurements provided by the Customer. The information and measurements are both vital for proper provision of the Service.With respect to kitchens, this design will also be based on the blueprint provided by the measurer as part of the verification, which will be done at no additional cost by a partner company, either external or internal to IKEA (depending on the IKEA store responsible for the service), to ensure that the kitchen is correctly planned based on the size of the room, the height of the kitchen, and the location, measurement and size of windows and doors and of electrical sockets and water, drain and exhaust pipes. 
  • The Service is provided on a one-time basis in a single session on the date agreed upon by both Parties, with a maximum duration of (i) three (3) hours for kitchens; and (ii) two (2) hours for living rooms and bedrooms (excluding bedrooms for children and teenagers). This is unless otherwise agreed by the Parties. 
  • IKEA shall provide the Customer, within a maximum of seven (7) days, with a 3D blueprint in .pdf format, the delivery of which shall exempt IKEA from any other obligations or responsibilities.
  • The design will be used as a base to prepare the quote that will be provided to the Customer, and will contain the items and products, and their corresponding prices, based on the criteria chosen (model, colour and sizes). This quote will be valid for thirty (30) calendar days.
  • Under no circumstances will IKEA be responsible for any third-party costs arising from design changes requested by the Customer.
  • Once the verification service has been completed, the Customer must sign a document stating their approval.

 

5. PRICE AND PAYMENT.

  • The in-store or remote Service is free with respect to the design of the room (kitchen, bedroom, living room, bathroom or workspace). This is not the case for the verification for kitchens, or for the installation of sliding doors on SKYTTA wardrobes, in accordance with the terms stipulated in the previous section.The at-home Service costs forty-nine euro (EUR 49). 
  • The Service must be paid for in full upon signing these Conditions. Payment may be made, depending on the method and in accordance with IKEA policies in that regard, via the link in the confirmation email, and all of the following methods are accepted: bank card, bank transfer, Bizum and PayPal. Cash payments will not be accepted, unless the purchase is made in an IKEA store and can be paid for by those means at that very moment.
  • Products included in plans or quotes, or that are discussed during the consultation, do not form part of the Service, and are not included in the price in any way. Therefore, they may only be purchased in accordance with the usual purchasing system, at the price and under the conditions in effect on the date on which the purchase of each product is made, including in cases where the product quotes provided during the consultation stipulate different conditions.
  • IKEA will enable the Customer to acquire services in addition to their purchase, such as the home delivery and installation service, which the Customer must purchase from partner companies, whether external or internal to IKEA, in accordance with the conditions agreed with said partner companies.

 

6. AFTER-SALES SERVICE.

In the event that the Customer has a problem with the purchase of the Service, they should contact the store of their choice. Moreover, they may contact IKEA Customer Service by phoning  900 400 922 between 8:00 and 22:00 from Monday to Saturday, and between 10:00 and 20:00 on Sundays and public holidays.

7. CANCELLATION OF THE VERIFICATION SERVICE.

The Customer acknowledges having been informed that, following initiation of the Service with the Customer's consent and once the Service has been provided or completed in full, the Customer may no longer cancel the Service provided.

8. APPLICABLE LEGISLATION SUBMISSION TO JURISDICTION.

These Conditions will be governed by applicable Spanish legislation with respect to any aspects that are not provided for therein with regard to interpretation, validity and implementation.

The Parties undertake to submit any dispute that may arise with regard to the interpretation or execution of these contractual conditions to the courts and tribunals of the city corresponding to the home address of the Customer.

These General Contract Terms and Conditions (the "Terms and Conditions") shall expressly govern the business relationship between IKEA IBÉRICA, S.A.U. ("IKEA"), with tax ID no. A-28812618 and registered address at Avenida Matapiñonera, nº 9, 28703, San Sebastián de los Reyes (Madrid, Spain), and the users or customers(the "Customer"), who order the interior design service for their home, whether in store, remotely via the IKEA website (hereinafter referred to jointly as the "Service").

1. INFORMATION AND STATEMENTS BEFORE ORDERING.

  • IKEA hereby states that this Service is for Customers who will use the IKEA products for domestic purposes and, in any case, completely separately from their business and/or professional activities.
  • By using the Service, the Customer fully and unconditionally accepts all the content of the following Terms and Conditions, as well as any terms and conditions for using the IKEA website and the IKEA privacy policy applicable at any given time and available via the following link:https://www.ikea.com/es/en/customer-service/privacy-policy/
  • The Customer may access, save and print these Terms and Conditions before ordering and during the purchase process.
  • All information and personal data provided by the Customer shall be handled in accordance with the IKEA Privacy Policy, following the data processing procedures specified in these Conditions and in line with the options selected by the Customer at the time of accepting these Conditions. The Customer declares that all information and data that they provide to IKEA is truthful and reflects their true situation.

  • The Customer states that they are over eighteen (18) years of age and have the necessary and sufficient legal capacity and ability to enter into financial contracts.
  • The Customer is hereby informed that the Service provided by IKEA under no circumstances implies physical modifications to the property, instead they are simply suggestions for decoration. The Customer guarantees that the room(s) in the property for which they are purchasing the Service is/are located within Spain's national territory on the Iberian Peninsula and, if this is not the case, accepts liability for any prejudice caused to IKEA as a result of failure to comply with this guarantee.The Customer purchases this Service in their capacity as the user, holder or tenant of, or any other position that entitles them to inhabit and/or exercise professional activity in, the property specified above, and exempts IKEA
  • from any third-party claims resulting from any breach in that regard.

  • The fabrication of its products is subject to the quality, environmental and corporate responsibility standards of IKEA, based on international principles shared by regulations and established under standards such as those mentioned above. In addition, internal auditors continuously verify with all product and service suppliers for IKEA that they are operating correctly.

3. TERMS AND CONDITIONS FOR PROVIDING THE SERVICE.

  • IKEA hereby states that the Service does not include anything besides a consultation for the design and decoration of the specified room (kitchen, bathroom, living room or bedroom – including for children and teenagers – and workspaces).
    The products and additional services must be purchased and paid for at the time that they are acquired, whether in store or remotely; under no circumstances will they form part of the Service.
  • The Customer states that the living quarters of the Room, its space and physical layout are in good condition; this includes, where applicable, water and electrical connections, as well as flooring and walls with their completed finishes.
  • IKEA will not provide the Service on the basis of non-IKEA products being used.
  • Products included in plans or quotes, or that are discussed during the consultation, do not form part of the Service and, therefore, may only be purchased in accordance with the usual purchasing system, at the price and under the conditions listed on the date on which the purchase of each product is made, including in cases where the product quotes provided during the consultation stipulate different conditions.
    Likewise, the Service does not include any delivery, assembly or other additional service that is not expressly referred to in these Conditions.
  • As an essential condition for providing the Service, the Customer exempts IKEA from any liability and, therefore, will be solely responsible for taking into consideration and making use of the products in accordance with the corresponding technical specifications and instructions for use; as well as for verifying the correct location and placement of the product in the property, in accordance with the building book, the obligations for use and maintenance of the property, emergency and evacuation manuals and any other requirements that may emanate from the manuals and regulations that are applicable to the property in question, of which IKEA has no knowledge and for which the Customer will be solely responsible.
  • In light of the foregoing, it shall be exclusively the Customer's responsibility to verify that the design and documentation generated by IKEA meets or must be amended, by the Customer, to meet the required safety, habitability and suitability conditions and other any obligations that, in their capacity as user, owner, tenant or any other title, they are required to meet in order to use this service in relation to the property.
  • Accordingly, the advice provided under this Service is of an informative nature and under no circumstances may the inability of any kind (material, legal, financial, administrative, etc.) to bring the project resulting from the service to physical fruition be considered attributable to IKEA, with IKEA being completely exempt from any kind of liability in this regard.
  • For the proper provision of the Service, it is essential that the Customer provides the measurements of the room to which the IKEA advising relates; the Customer may add any information or graphic elements regarding the room (plans, images, etc.), which IKEA, at its sole discretion, may take into consideration or disregard.
    In the event of discrepancy between the documents provided by the Customer, the measurements will always take precedence; no other documents shall be binding on IKEA.
    The Customer assumes responsibility for any figures, measurements, descriptions, images, plans and information, etc. contained in the documents provided, and exempts IKEA from any liability in the event that any part of the information provided does not correspond to the physical reality (measurements, plans, spaces, layouts, etc.) of the room, including if said document was disregarded by IKEA.
  • If any case of force majeure or a circumstance attributable to the Customer arises that prevents any of the obligations assumed by IKEA for this Service from being fulfilled, this shall not imply non-compliance by IKEA nor invoke its liability or lead to an additional obligation on its part.
    Likewise, if any case of force majeure or a circumstance attributable to IKEA arises that prevents any of the obligations assumed by the Customer from being fulfilled, this shall not imply non-compliance by the Customer nor invoke its liability or lead to an additional obligation on their part.
  • All information that is provided by the Customer shall become the property of IKEA, with IKEA not being liable in any way for the veracity, precision, exactness or sufficiency of the information exchanged between the Parties.
  • It is possible that a product that IKEA confirms as being available at the time of the order may run out of stock. If this happens, IKEA shall inform the Customer via email and/or by phone within a minimum of forty-eight (48) hours prior to the delivery of the products, and will offer the Customer one of the following alternatives: (i) delivery of the product later than the date initially indicated; (ii) replacement of the product for a similar one in terms of characteristics, functions, quality and price; and/or (iii) refund of the price paid within a maximum of seven (7) calendar days of the Customer indicating that this is their chosen alternative.

4. DESCRIPTION OF SERVICE.

  • IKEA shall provide the Service in store or remotely for the purchase of kitchens, bathrooms, living rooms, bedrooms (including for children and teenagers) and workspaces, and the Service will include the design and planning of the corresponding room by IKEA based on (i) the information provided in the questionnaire that the Customer is to complete during the appointment booking process; and (ii) the measurements provided by the Customer. The information and measurements are both vital for the proper provision of the Service.
  • IKEA shall send the Customer automatic confirmation of the specific time and date that the Service will be provided.
  • The Customer must send IKEA the measurements of the area that is the subject of the consultation using the address provided by IKEA prior to the appointment.
  • The Service is provided on a one-time basis in a single session, in store or remotely, on the date and by the means agreed upon by both Parties, with a maximum duration – depending on the type of appointment, the Customer's consultation needs and the Room – of ninety (90) minutes.
  • IKEA will deliver to the Customer, within a maximum of two (2) days in the case of one Room, and seven (7) days in the case of more Rooms, a floor with the layout, 3D images of all the products, a detailed quote and tips and tricks for decorating that suit their needs. All documentation will be delivered in PDF format, the delivery of which shall exempt IKEA from any other obligations or responsibilities.
    The design will be used as a base to prepare the quote that will be provided to the Customer, and will contain items and products, and their corresponding prices, based on the criteria chosen (model, colour and sizes, etc.). This quote will be valid for thirty (30) calendar days.
  • For this Service, IKEA also offers the Customer the possibility of requesting assistance, by means of the verification service, in taking measurements, which may be added for a fixed amount of forty euro (EUR 40), regardless of whether the customer ultimately buys the products for the room at IKEA.
    Nevertheless, if the Customer ultimately acquires the products for the room at IKEA, following the purchase of the planning service, this amount will be deducted from the price of the products.
    Verification will be mandatory in two cases: (i) for kitchen installations; and (ii) when sliding doors are to be installed on SKYTTA wardrobes.
  • If kitchen installation is purchased from a partner company, whether external or internal to IKEA (depending on the IKEA store responsible for the service), said company will verify the kitchen prior to installation – a process unrelated to IKEA – in order to verify that the design is correctly adapted to the Customer's kitchen.
  • Once the verification service has been completed, the Customer must sign a document stating their approval.

B) AT-HOME ADVISING.

  • Subject to the availability of the Service, depending on the IKEA store responsible, IKEA shall provide the Service at home for the purchase of kitchens, living rooms and bedrooms (excluding bedrooms for children and teenagers), and the Service will include the design and planning of the corresponding Room by IKEA based on (i) the information provided in the questionnaire that the Customer is to complete during the appointment booking process; and (ii) the measurements provided by the Customer. The information and measurements are both vital for proper provision of the Service.
    With respect to kitchens, this design will also be based on the blueprint provided by the measurer as part of the verification, which will be done at no additional cost by a partner company, either external or internal to IKEA (depending on the IKEA store responsible for the service), to ensure that the kitchen is correctly planned based on the size of the room, the height of the kitchen, and the location, measurement and size of windows and doors and of electrical sockets and water, drain and exhaust pipes.
  • The Service is provided on a one-time basis in a single session on the date agreed upon by both Parties, with a maximum duration of (i) three (3) hours for kitchens; and (ii) two (2) hours for living rooms and bedrooms (excluding bedrooms for children and teenagers). This is unless otherwise agreed by the Parties.

  • Under no circumstances will IKEA be responsible for any third-party costs arising from design changes requested by the Customer.
  • Once the verification service has been completed, the Customer must sign a document stating their approval.

5. PRICE AND PAYMENT.

  • The Service, whether provided in store or remotely, costs twenty-nine euro (EUR 29) per room. In the event that there is more than one room, the Customer must communicate the number of rooms subject to the design to IKEA before the service is provided.
    The verification service for kitchens or the installation of sliding doors on SKYTTA wardrobes, also has an additional cost in accordance with the terms stipulated in the previous section.
  • The Service must be paid for in full upon signing these Conditions.
    Payment may be made, depending on the method and in accordance with IKEA policies in that regard, via the link in the confirmation email, and all of the following methods are accepted: bank card, bank transfer, Bizum and PayPal. Cash payments will not be accepted, unless the purchase is made in an IKEA store and can be paid for by those means at that very moment.
  • Products included in plans or quotes, or that are discussed during the consultation, do not form part of the Service, and are not included in the price in any way. Therefore, they may only be purchased in accordance with the usual purchasing system, at the price and under the conditions in effect on the date on which the purchase of each product is made, including in cases where the product quotes provided during the consultation stipulate different conditions.
  • IKEA will enable the Customer to acquire services in addition to their purchase, such as the home delivery and installation service, which the Customer must purchase from partner companies, whether external or internal to IKEA, in accordance with the conditions agreed with said partner companies.

6. AFTER-SALES SERVICE.

In the event that the Customer has a problem with the purchase of the Service, they should contact the store of their choice. Moreover, they may contact IKEA Customer Service by phoning  900 400 922 between 8:00 and 22:00 from Monday to Saturday, and between 10:00 and 20:00 on Sundays and public holidays.

7. CANCELLATION OF THE VERIFICATION SERVICE.

The Customer acknowledges having been informed that, following initiation of the Service with the Customer's consent and once the Service has been provided or completed in full, the Customer may no longer cancel the Service provided.

8. APPLICABLE LEGISLATION. SUBMISSION TO JURISDICTION.

These Conditions will be governed by applicable Spanish legislation with respect to any aspects that are not provided for herein in terms of their interpretation, validity and implementation.

The Parties undertake to submit any dispute that may arise with regard to the interpretation or execution of these contractual conditions to the courts and tribunals of the city corresponding to the home address of the Customer. 22 May 2024

General contract terms and conditions for the interior design service for your company or business

These General Contract Terms and Conditions (the "Terms and Conditions") shall expressly govern the business relationship between IKEA IBÉRICA, S.A.U. ("IKEA"), with tax ID no. A-28812618 and registered address at Avenida Matapiñonera, nº 9, 28703, San Sebastián de los Reyes (Madrid, Spain), and the Business users or customers (whether they are businesses or professionals), regardless of whether or not they belong to the "IKEA Business Network" (the "Customer"), who order the interior design service for their company or business, whether in store, remotely, or at home via the IKEA website (hereinafter referred to jointly as the "Service").

1. INFORMATION AND STATEMENTS BEFORE ORDERING.

  • By using the Service, the Customer fully and unconditionally accepts all the content of the following Terms and Conditions, as well as any terms and conditions for using the IKEA website and the IKEA privacy policy applicable at any given time and available via the following link:https://www.ikea.com/es/en/customer-service/privacy-policy/
  • The Customer may access, save and print these Terms and Conditions before ordering and during the purchase process.
  • All information and personal data provided by the Customer shall be handled in accordance with the IKEA Privacy Policy, following the data processing procedures specified in these Conditions and in line with the options selected by the Customer at the time of accepting these Conditions. The Customer declares that all information and data that they provide to IKEA is truthful and reflects their true situation.
  • If the Customer does not provide all the required information, their appointment with an advisor will not be able to go ahead.
  • The Customer undertakes not to carry out any false or fraudulent planning, and IKEA reserves, in those circumstances, the right to cancel it and take appropriate action.
  • The Customer states that they are over eighteen (18) years of age and have the necessary and sufficient legal capacity and ability to enter into financial contracts.
  • The Customer is hereby informed that the Service provided by IKEA under no circumstances implies physical modifications to the property but are simply suggestions for decoration.
  • The Customer guarantees that the room(s) or workspace(s) in the property for which they are purchasing the Service is/are located within Spain's national territory on the Iberian Peninsula and, if this is not the case, accepts liability for any prejudice caused to IKEA as a result of failure to comply with this guarantee.
  • The Customer purchases this Service in their capacity as the user, holder or tenant of, or any other position that entitles them to inhabit and/or exercise professional activity in, the property specified above, and exempts IKEA from any third-party claims resulting from any breach in that regard.

2. IKEA PRODUCTS.

  • The Customer acknowledges that all products sold by IKEA are intended for domestic use and have been subjected to testing methods in accordance with relevant regulations and standards. However, some items in the range have been tested for professional or public use and meet the safety, durability and stability requirements established by the technical standards corresponding to such uses.
  • The guarantees offered by IKEA on all its products generally cover their household use. Before purchasing an IKEA item, the Customer must make sure that it is suitable for the use that they intend to make of it. For this purpose, product fact sheets are available to consult at IKEA stores and at www.IKEA.es.
  • IKEA accepts no liability for any claims arising from a use different from that for which the IKEA item is designed.
  • The Customer states that they are aware that IKEA does not have management systems certified in accordance with international standards (ISO 9000, ISO 14000, EMAS, SA8000, etc.) IKEA aims for the IKEA brand to be a trustworthy guarantee for its Customers in its own right, both with regard to the processes that it uses and the items that it sells, in terms of quality, safety, the environment and corporate responsibility. To do this, it has management systems and internal protocols covering all its processes, which are internally audited to ensure that they are carried out correctly in all IKEA units.
  • The fabrication of its products is subject to the quality, environmental and corporate responsibility standards of IKEA, based on international principles shared by regulations and established under standards such as those mentioned above. In addition, internal auditors continuously verify with all product and service suppliers for IKEA that they are operating correctly.

3. TERMS AND CONDITIONS FOR PROVIDING THE SERVICE.

  • IKEA hereby informs that the Service shall not cover anything beyond advising on the design of the specified room or workspace (including, where applicable, the kitchen, bathroom, office, etc.) (the "Room"), and shall take into account physical as well as functional separation. Accordingly, where there is no physical separation between spaces in a work environment but these spaces are dedicated for different purposes, functions or tasks, they will be considered as several Rooms.
    The products and additional services must be purchased and paid for at the time that they are acquired, whether in store or remotely; under no circumstances will they form part of the Service.
  • The Customer states that the living quarters of the Room, its space and physical layout are in good condition; this includes, where applicable, water and electrical connections, as well as flooring and walls with their completed finishes.
  • IKEA will not provide the Service on the basis of non-IKEA products being used.
  • Products included in plans or quotes, or that are discussed during the consultation, do not form part of the Service and, therefore, may only be purchased in accordance with the usual purchasing system, at the price and under the conditions listed on the date on which the purchase of each product is made, including in cases where the product quotes provided during the consultation stipulate different conditions.
    Likewise, the Service does not include any delivery, assembly or other additional service that is not expressly referred to in these Conditions.
  • As an essential condition for providing the Service, the Customer exempts IKEA from any liability and, therefore, will be solely responsible for taking into consideration and making use of the products in accordance with the corresponding technical specifications and instructions for use; as well as for verifying the correct location and placement of the product in the property, in accordance with the building book, the obligations for use and maintenance of the property, emergency and evacuation manuals and any other requirements that may emanate from the manuals and regulations that are applicable to the property in question, of which IKEA has no knowledge and for which the Customer will be solely responsible.
  • In light of the foregoing, it shall be exclusively the Customer's responsibility to verify that the design and documentation generated by IKEA meets or must be amended, by the Customer, to meet the required safety, habitability and suitability conditions and other any obligations that, in their capacity as user, owner, tenant or any other title, they are required to meet in order to use this service in relation to the property.
  • Accordingly, the advice provided under this Service is of an informative nature and under no circumstances may the inability of any kind (material, legal, financial, administrative, etc.) to bring the project resulting from the service to physical fruition be considered attributable to IKEA, with IKEA being completely exempt from any kind of liability in this regard.
  • For the proper provision of the Service, it is essential that the Customer provides the measurements of the Room to which the advice provided IKEA relates; the Customer may add any information or graphic elements regarding the room (plans, images, etc.), which IKEA, at its sole discretion, may take into consideration or disregard.
  • In the event of discrepancy between the documents provided by the Customer, the measurements will always take precedence; no other documents shall be binding on IKEA.
  • The Customer assumes responsibility for any figures, measurements, descriptions, images, plans and information, etc. contained in the documents provided, and exempts IKEA from any liability in the event that any part of the information provided does not correspond to the physical reality (measurements, plans, spaces, layouts, etc.) of the Room, including if said document was disregarded by IKEA.
  • If any case of force majeure or a circumstance attributable to the Customer arises that prevents any of the obligations assumed by IKEA for this Service from being fulfilled, this shall not imply non-compliance by IKEA nor invoke its liability or lead to an additional obligation on its part.
  • All information that is provided by the Customer shall become the property of IKEA, with IKEA not being liable in any way for the veracity, precision, exactness or sufficiency of the information exchanged between the Parties.
  • It is possible that a product that IKEA confirms as being available at the time of the order may run out of stock. If this happens, IKEA shall inform the Customer via email and/or by phone within a minimum of forty-eight (48) hours prior to the delivery of the products, and will offer the Customer one of the following alternatives: (i) delivery of the product later than the date initially indicated; (ii) replacement of the product for a similar one in terms of characteristics, functions, quality and price; and/or (iii) refund of the price paid within a maximum of seven (7) calendar days of the Customer indicating that this is their chosen alternative.

4. DESCRIPTION OF SERVICE.

  • IKEA shall provide the Service in store or remotely for the purchase of kitchens, bathrooms, living rooms, bedrooms (including for children and teenagers) and workspaces, and the Service will include the design and planning of the corresponding Room by IKEA based on (i) the information provided in the questionnaire that the Customer is to complete during the appointment booking process; and (ii) the measurements provided by the Customer. The information and measurements are both vital for the proper provision of the Service.
  • IKEA shall send the Customer confirmation of the specific time and date that the Service will be provided. Said time and date will be confirmed with the Customer via a telephone call from an IKEA specialist.
  • The Customer must send IKEA the measurements of the area that is the subject of the consultation using the address provided by IKEA prior to the appointment.
  • The Service is provided on a one-time basis in a single session, in store or remotely, on the date and by the means agreed upon by both Parties, with a maximum duration – depending on the type of appointment, the Customer's consultation needs and the room – of ninety (90) minutes.
  • IKEA will deliver to the Customer, within a maximum of two (2) days in the case of one Room, and seven (7) days in the case of more Rooms, a floor with the layout, 3D images of all the products, a detailed quote, a lighting plan and tips and tricks for decorating that suit their needs. All documentation will be delivered in PDF format, the delivery of which shall exempt IKEA from any other obligations or responsibilities.
    The design will be used as a base to prepare the quote that will be provided to the Customer, and will contain items and products, and their corresponding prices, based on the criteria chosen (model, colour and sizes, etc.). This quote will be valid for thirty (30) calendar days.
  • For this Service, IKEA also offers the Customer the possibility of requesting assistance, by means of the verification service, in taking measurements, which may be added for a fixed amount of forty euro (EUR 40), regardless of whether the customer ultimately buys the products for the Room at IKEA. Nevertheless, if the Customer ultimately acquires the products for the Room at IKEA, following the purchase of the planning service, this amount will be deducted from the price of the products. Verification will be mandatory in two cases: (i) for kitchen installations; and (ii) when sliding doors are to be installed on SKYTTA wardrobes.
  • If kitchen installation is purchased from a partner company, whether external or internal to IKEA (depending on the IKEA store responsible for the service), said company will verify the kitchen prior to installation – a process unrelated to IKEA – in order to verify that the design is correctly adapted to the Customer's kitchen.
  • Once the verification service has been completed, the Customer must sign a document stating their approval.

A) AT-HOME ADVISING.

  • Subject to the availability of the Service, depending on the IKEA store responsible, IKEA shall provide the Service at home for the purchase of kitchens, living rooms and bedrooms (excluding bedrooms for children and teenagers), and the Service will include the design and planning of the corresponding Room by IKEA based on (i) the information provided in the questionnaire that the Customer is to complete during the appointment booking process; and (ii) the measurements provided by the Customer. The information and measurements are both vital for proper provision of the Service.
    With respect to kitchens, this design will also be based on the blueprint provided by the measurer as part of the verification, which will be done at no additional cost by a partner company, either external or internal to IKEA (depending on the IKEA store responsible for the service), to ensure that the kitchen is planned correctly based on the size of the Room, the height of the kitchen, and the location, measurement and size of windows and doors and of electrical sockets and water, drain and ventilation ducting for extraction.
  • The Service is provided on a one-time basis in a single session on the date agreed upon by both Parties, with a maximum duration of (i) three (3) hours for kitchens; and (ii) two (2) hours for living rooms and bedrooms (excluding bedrooms for children and teenagers). This is unless otherwise agreed by the Parties.             IKEA shall provide the Customer, within a maximum of seven (7) days, with a 3D blueprint in PDF format, the delivery of which shall exempt IKEA from any other obligations or responsibilities.
  • The design will be used as a base to prepare the quote that will be provided to the Customer, and will contain the items and products, and their corresponding prices, based on the criteria chosen (model, colour and sizes). This quote will be valid for thirty (30) calendar days.
  • Under no circumstances will IKEA be responsible for any third-party costs arising from design changes requested by the Customer.
  • Once the verification service has been completed, the Customer must sign a document stating their approval.

5. PRICE AND PAYMENT.

  • The Service, whether provided in store or remotely, costs ninety-nine euro (EUR 99), with this price reducing to fifty-nine euro (EUR 59) if the Customer is a member of the IKEA Business Network. The verification service for kitchens or the installation of sliding doors on SKYTTA wardrobes, also has an additional cost in accordance with the terms stipulated in the previous section.
  • The Service must be paid for in full upon signing these Conditions. Payment may be made, depending on the method and in accordance with IKEA policies in that regard, via the link in the confirmation email, and all of the following methods are accepted: bank card, bank transfer, Bizum and PayPal. Likewise, the Service does not include any delivery, assembly or other additional service that is not expressly referred to in these Conditions.
  • As an essential condition for providing the Service, the Customer exempts IKEA from any liability and, therefore, will be solely responsible for taking into consideration and making use of the products in accordance with the corresponding technical specifications and instructions for use; as well as for verifying the correct location and placement of the product in the property, in accordance with the building book, the obligations for use and maintenance of the property, emergency and evacuation manuals and any other requirements that may emanate from the manuals and regulations that are applicable to the property in question, of which IKEA has no knowledge and for which the Customer will be solely responsible.
  • In light of the foregoing, it shall be exclusively the Customer's responsibility to verify that the design and documentation generated by IKEA meets or must be amended, by the Customer, to meet the required safety, habitability and suitability conditions and other any obligations that, in their capacity as user, owner, tenant or any other title, they are required to meet in order to use this service in relation to the property.
  • Accordingly, the advice provided under this Service is of an informative nature and under no circumstances may the inability of any kind (material, legal, financial, administrative, etc.) to bring the project resulting from the service to physical fruition be considered attributable to IKEA, with IKEA being completely exempt from any kind of liability in this regard.
  • For the proper provision of the Service, it is essential that the Customer provides the measurements of the Room to which the IKEA advising relates; the Customer may add any information or graphic elements regarding the room (plans, images, etc.), which IKEA, at its sole discretion, may take into consideration or disregard.
    In the event of discrepancy between the documents provided by the Customer, the measurements will always take precedence; no other documents shall be binding on IKEA.

  • IKEA shall provide the Service in store or remotely for the purchase of kitchens, bathrooms, living rooms, bedrooms (including for children and teenagers) and workspaces, and the Service will include the design and planning of the corresponding Room by IKEA based on (i) the information provided in the questionnaire that the Customer is to complete during the appointment booking process; and (ii) the measurements provided by the Customer. The information and measurements are both vital for the proper provision of the Service.
  • IKEA shall send the Customer automatic confirmation of the specific time and date that the Service will be provided.
  • The Customer must send IKEA the measurements of the area that is the subject of the consultation using the address provided by IKEA prior to the appointment.
  • The Service is provided on a one-time basis in a single session, in store or remotely, on the date and by the means agreed upon by both Parties, with a maximum duration sixty (60) minutes, with the exception of the kitchen planning service, which will have a maximum duration of ninety (90) minutes.
  • IKEA will deliver to the Customer, within a maximum of two (2) days, a Room plan produced using the www.ikea.es planner, a detailed quote including services, payment and financing options and support with the purchase process. All deliverables will be made available in PDF format, the delivery of which shall exempt IKEA from any other obligations or responsibilities.
    The plan will be used as a base to prepare the quote that will be provided to the Customer, and will contain items and products, and their corresponding prices, based on the criteria chosen (model, colour and sizes, etc.). This quote will be valid for thirty (30) calendar days.
  • For kitchen planning, IKEA also offers the Customer the possibility of requesting assistance, by means of the verification service, in taking measurements, which may be added for a fixed amount of forty euro (EUR 40), regardless of whether the customer ultimately buys the products for the Room at IKEA. 
    Nevertheless, if the Customer ultimately acquires the products for the Room at IKEA, following the purchase of the planning service, this amount will be deducted from the price of the products.
    Verification will be mandatory in two cases: (i) for kitchen installations; and (ii) when sliding doors are to be installed on SKYTTA wardrobes.
  • If kitchen installation is purchased from a partner company, whether external or internal to IKEA (depending on the IKEA store responsible for the service), said company will verify the kitchen prior to installation – a process unrelated to IKEA – in order to verify that the design is correctly adapted to the Customer's kitchen.
  • Once the verification service has been completed, the Customer must sign a document stating their approval.

5. PRICE AND PAYMENT.

  • The in-store or remote Service is free with respect to the plan of the Room (kitchen, bedroom, living room, bathroom or workspace). This is not the case for the verification for kitchens, or for the installation of sliding doors on SKYTTA wardrobes, in accordance with the terms stipulated in the previous section.
  • The Service must be paid for in full upon signing these Conditions.
    Payment may be made, depending on the method and in accordance with IKEA policies in that regard, via the link in the confirmation email, and all of the following methods are accepted: bank card, bank transfer, Bizum and PayPal. Cash payments will not be accepted, unless the purchase is made in an IKEA store and can be paid for by those means at that very moment.
  • Products included in plans or quotes, or that are discussed during the consultation, do not form part of the Service, and are not included in the price in any way. Therefore, they may only be purchased in accordance with the usual purchasing system, at the price and under the conditions in effect on the date on which the purchase of each product is made, including in cases where the product quotes provided during the consultation stipulate different conditions.
  • IKEA will enable the Customer to acquire services in addition to their purchase, such as the home delivery and installation service, which the Customer must purchase from partner companies, whether external or internal to IKEA, in accordance with the conditions agreed with said partner companies.

6. AFTER-SALES SERVICE.

In the event that the Customer has a problem with the purchase of the Service, they should contact the store of their choice. Moreover, they may contact IKEA Customer Service by phoning  900 400 922 between 8:00 and 22:00 from Monday to Saturday, and between 10:00 and 20:00 on Sundays and public holidays.

7. CANCELLATION OF THE VERIFICATION SERVICE.

The Customer acknowledges having been informed that, following initiation of the Service with the Customer's consent and once the Service has been provided or completed in full, the Customer may no longer cancel the Service provided.

8. APPLICABLE LEGISLATION. SUBMISSION TO JURISDICTION.

These Conditions will be governed by applicable Spanish legislation with respect to any aspects that are not provided for herein in terms of their interpretation, validity and implementation.

The Parties undertake to submit any dispute that may arise with regard to the interpretation or execution of these contractual conditions to the courts and tribunals of the city corresponding to the home address of the Customer.
