Customer Ratings and Reviews Terms of Use

1. These Terms of Use apply when you use the Customer Ratings and Review service (the “CRR Service”) offered by Ikano (Philippines) Inc. and posted on the IKEA Philippines website IKEA.ph. “IKEA Philippines/we/our/us” in these Terms of Use refer to Ikano (Philippines) Inc.

2. To the extent of any conflict between the Terms of Use for access and/or use of our website, the Personal Data Privacy Policy, and these Terms of Use, these Terms of Use shall prevail with respect to the CRR Service.

3. By submitting any content to us, you represent and warrant that:
a) You purchased the reviewed product directly from IKEA Philippines;
b) You are the sole author and owner of the intellectual property rights of the content;
c) All intellectual property rights that you may have in such content have been voluntarily waived by you;
d) All content that you post is accurate;
e) You are at least 18 years old;
f) Use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity.

4. You further agree and warrant that you shall not submit any content:
a) That is known by you to be false, inaccurate or misleading;
b) That infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
c) That violates any law or regulation.
d) That is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;
e) For which you were compensated or granted any consideration by any third party;
f) That includes any information that references other websites, addresses, email addresses, contact information or phone numbers;
g) That contains any computer viruses, worms or other potentially damaging computer programs or files.
h) That contains personal data besides than your name.

5. You agree to indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable lawyers' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party.

6. For any content that you submit, you grant us a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you. All content that you submit may be used at our sole discretion.

7. We reserve the right to refuse to post, change, condense or delete any content on the website that we deem, in our sole discretion, to violate the content guidelines or any other provision of these Terms of Use. We do not guarantee that you will have any recourse through us to edit or delete any reviews you have posted.

8. Ratings and written reviews are generally posted within four business days. However, we reserve the right to remove or to refuse to post any submission for any reason. You acknowledge that you, not us, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on our part, our agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.

9. These Terms of Use are governed by the laws of Philippines and any disputes in relation to them are subject to the exclusive jurisdiction and appropriate courts of Philippines.

10. By submitting your content to us, you consent to our collection of your content and any personal data related to your content, including your name and email address. We will only use your personal data for purposes of posting your review on our website and for contacting you about the status of your review and other administrative purposes, unless you provide your consent for us to use your personal data for any other agreed purpose. Your personal data may be transferred to servers located outside the country in which you live or to affiliates or other authorized third parties based in other countries so that they may process personal data on our behalf. You agree to the collection, use, disclosure, transfer, storage and processing of your personal data in accordance with these Terms of Use, our Privacy Policy and applicable data protection laws and regulations.
