IKEA my kitchen workspace terms of use

These Terms of Use (“Terms”) apply to the use of the IKEA My Kitchen Workspace customer portal available at https://services.ikea.com/s/login/?language=en_CA (the “Workspace”).  These Terms set out the rights and obligations of all users regarding the use of the Workspace.

The Workspace is owned and operated by IKEA Kitchen Services Inc. (“IKEA”). 

By signing up and using the Workspace, you agree that you have read, understood, and accepted these Terms, as they may be amended and updated by IKEA from time to time. Your access and use of the Workspace is also conditioned on your acceptance of and compliance with IKEA’s Privacy Policy.  Our Privacy Policy describes IKEA’S policies and procedures on the collection, use, and disclosure of your personal information.  

You represent that you are over the age of 18. IKEA does not permit those under 18 to use the Workspace.

The Workspace is intended as a one-stop shop to manage appointment details and upload and view installation project documents. The Workspace and its content will be available to you for the duration of your project for you to access and refer to at any time.  

You may sign up for a Workspace portal account by providing your first and last name, email address, home address, and creating a unique password.  When you create an account, you must provide us with information that is accurate, complete and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for maintaining the confidentiality of your account and password and restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.  You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Subject to your compliance with these Terms, IKEA or its content providers, as the case may be, grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Workspace.

If you submit content or material on the Workspace, you grant IKEA, its affiliates, and its licensees a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute and display such content throughout the world in any media, without credit, notice, approval or further compensation to you. 

THE SERVICE IS PROVIDED TO YOU ‘AS IS’ AND ‘AS AVAILABLE’ AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND.  TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IKEA, ON ITS OWN BEHALF AND ON BEHALF OF ITS AFFILIATES AND ITS AND THEIR RESPECTIVE LICENSORS AND SERVICE PROVIDERS, EXPRESSLY DISCLAIMS AND WAIVES ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE WORKSPACE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND WARRANTIES THAT MAY ARISE OUT OF THE COURSE OF DEALING.  IKEA DOES NOT WARRANT THAT THE WORKSPACE OR INFORMATION, CONTENT, MATERIALS, GRATUITOUS SERVICES, AND SOFTWARE INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH IKEA’S WEBSITE, IKEA’S SERVERS, OR ELECTRONIC COMMUNICATIONS SENT FROM IKEA, ARE, AS APPLICABLE, FREE OF VIRUSES OR OTHER HARMFUL CONTENTS OR ARE ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE OR ARE FREE FROM DELAYS, INTERRUPTIONS, OR INTERCEPTIONS.  TO THE FULLEST EXTENT PERMISSIBLE BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY DAMAGES OR LOSS OF ANY KIND ARISING FROM THE USE OF OR INABILITY TO USE THE WORKSPACE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, GRATUITOUS SERVICES, OR SOFTWARE INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH IKEA’S WEBSITE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, SPECIAL INCIDENTAL, PUNITIVE, EXEMPLARY AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING, AND WHETHER BASED IN CONTRACT, TORT, CIVIL LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL BASIS.

IKEA reserves the right to suspend or terminate your Workspace account if it suspects unauthorized use or abuse of its services.

IKEA reserves the right to amend, alter, withdraw, suspend, or terminate the Workspace or these Terms of Use at any time without notice or compensation.
