TERMS AND CONDITIONS FOR THE "MANAGE THE REPLACEMENT OF DAMAGED PRODUCTS WITHIN SEVEN DAYS OF DELIVERY" FUNCTIONALITY UNDER THE "MANAGE AND CHECK THE STATUS OF YOUR ORDER" SECTION ON WWW.IKEA.COM/ES/EN
This document governs the General Terms and Conditions applicable to the customer managing the replacement of damaged goods within seven (7) days of the delivery of purchases made from IKEA IBÉRICA, S.A., with Tax ID CIF A-28812618 and registered address at Avenida Matapiñonera 9, 28703, San Sebastián de los Reyes, Madrid, Spain (hereinafter "IKEA") and for which the customer used the IKEA delivery service. This functionality can be found in the "Manage and check the status of your order" section of the website www.ikea.com/es/en.
By using this functionality, the customer declares that they have the sufficient legal capacity to do so and that they understand and accept these terms and conditions in full. Similarly, they consent to be bound by the Privacy Policy and the Cookie Policy, which are both available at www.ikea.com/es/en/.
IKEA may modify these terms and conditions, as well as the Privacy Policy and the Cookie Policy, at any time and without prior notice, by publishing these modifications on the IKEA website, in order to make them known, and so that the customer may read them carefully each time they access this functionality. The customer accepts that the terms and conditions for the "Manage the replacement of damaged goods within seven days of delivery" functionality, the Privacy Policy and the Cookie Policy, which are available on the website at any given time, shall apply and that their acceptance is an essential pre-requisite in order for the customer to use this service or functionality. IKEA accepts no liability for damages or harm of any nature arising from the exercising of this power.

SCOPE OF APPLICATION: This service or functionality is only available, and therefore these terms and conditions only apply, to customers who meet all of the following requirements:
- they are a private individual,
- they have purchased one or more products from IKEA and have opted for the IKEA delivery service,
- the products have arrived damaged, and
- no more than seven days have elapsed since delivery.
Situations concerning quality are expressly excluded. This is understood to mean situations in which there are concerns about the health and safety of the products. In this event, the customer will be required to contact IKEA via any of the other means available and they will not be able to use this functionality. If they do use the functionality, IKEA accepts no responsibility for any losses or damages of any nature that may arise as a result of this situation.
The aforementioned time-frame of seven days is not to be understood as a time limit on the exercising of any legal and/or commercial guarantee, nor does it limit any other right held by the customer pursuant to the applicable standards. The aforementioned time-frame refers exclusively to the fact that this functionality is only available via this channel for seven days following delivery. If, after this seven-day period, you wish to exercise the legal guarantee or any other right you may have as a consumer, you can contact IKEA via any of the means of communication available and that you can find at https://www.ikea.com/es/en/customer-service/contact-us/
GEOGRAPHICAL SCOPE: This functionality is available in all of mainland Spain. It is therefore not available in the Canary Islands, the Balearic Islands, Ceuta or Melilla.
WHAT IS THIS FUNCTIONALITY FOR?: If you meet the requirements set out in the section entitled "Scope of application", you can submit a claim to IKEA for a replacement or refund for the product that was subject to the claim.
When you access the functionality, we will ask you a series of questions and, based on your preferred resolution (replacement or refund) and the answers you provide about the product you have purchased, the tool will send you an email to the email address previously provided, indicating the new delivery date for the replacement product and the collection date for the damaged product, or confirming that we will be issuing a refund and informing you of the collection date for the damaged product.
At the end of the questions, just below the box for accepting the terms and conditions, you are informed that IKEA may, at its sole discretion, in the email you receive upon completing the questions and requesting your replacement or refund, ask you to recycle the product, subject to the claim, yourself, instead of IKEA collecting it. If we confirm that we will not be collecting the product subject to the claim, you undertake to recycle it yourself. IKEA accepts no responsibility for any damages or losses of any nature that could arise as a result of using and/or failing to recycle this product.
INVALIDITY: The declaration of any of these terms and conditions as null, invalid or ineffective will not affect the validity or legal effectiveness of the remaining terms and conditions.Should any of the Parties, at any time, waive the need for compliance with any of the terms and conditions stipulated, this will not constitute a general waiver of the need for compliance with any other terms or conditions, nor will it create an acquired right for another Party.
JURISDICTION: Any discrepancies that may arise in relation to the interpretation of and/or compliance with these terms and conditions shall be resolved in accordance with Spanish law and any disputes shall be settled before the Courts in the jurisdiction applicable by law.
