General Terms and Conditions of Contract for the Virtual Advisor Service
These General Terms and Conditions of Contract shall expressly govern the commercial relationships that arise between IKEA IBÉRICA, S.A. and the users or customers that contract the virtual advisor service offered on the IKEA website.
IKEA hereby states that this service is intended for customers using IKEA products for household purposes, and in all cases, completely outside their business and/or professional activity.
1.INFORMATION AND STATEMENTS BEFORE ORDERING
Customers may access, save and print these general conditions for ordering for their own information before ordering and during the purchasing process.
All information and personal data provided by the Customer when using this website will be treated in accordance with the IKEA Privacy Policy, according to the data processing specified in these Conditions of Purchase as well as in accordance with the options that the Customer has selected at the time of accepting the Conditions of Purchase.The Customer declares that all information and data they provide to IKEA is truthful and reflects their actual situation. If the Customer does not provide all the required information, their appointment with an advisor will not be possible.
The Customer undertakes not to carry out any false or fraudulent planning, and IKEA reserves, in those circumstances, the right to cancel it and take appropriate action.
The Customer states that they are over 18 years of age and have the necessary and sufficient legal capacity to enter into financial contracts.
2.IKEA PRODUCTS
The Customer acknowledges that all products sold by IKEA are intended for domestic use and have been subjected to testing methods in accordance with relevant regulations and standards.However, some items in the range have been tested for professional or public use and meet the safety, durability and stability requirements established by the technical standards corresponding to such uses.
The guarantees offered by IKEA on all its products generally cover their household use.Before purchasing an IKEA item, the Customer must make sure that it is suitable for the use that they intend.For this purpose, product fact sheets are available to consult at IKEA stores and at www.IKEA.es.
IKEA accepts no liability for any claims arising from a use different from that for which the IKEA item is designed.
The Customer acknowledges they are aware that IKEA does not have management systems certified in accordance with international standards (ISO9000, ISO 14000, EMAS, SA8000 etc.)IKEA aims for the IKEA brand itself to be a trustworthy guarantee for its Customers, for both the processes they follow and the items they sell in terms of: quality, safety, the environment and corporate responsibility.To do this, it has management systems and internal protocols covering all its processes, which are internally audited to ensure that they are carried out correctly in all IKEA units.
The manufacture of its products is subject to IKEA standards of quality, environment and corporate responsibility, based on international principles shared by regulations and established under the standards such as those mentioned above.In addition, internal auditors continuously verify with all product and service suppliers for IKEA that they are operating correctly.
3.IKEA INFORMATION
The service provided by IKEA IBÉRICA, S.A., with CIF (Certifiado de Identificación Fiscal – Spanish tax identification number) A28812618, with registered office at Avenida Matapiñonera 9, 28703, San Sebastián de los Reyes, Madrid, (Spain), registered in the Madrid Mercantile Register under Volume 1251, Section 8, Folio 102, Sheet 23549.
4.CONDITIONS FOR PROVIDING THE SERVICE
IKEA states that the customised remote advisor service does not include anything besides a consultation for the design of the specified room (kitchen, bedroom, living room or bathroom). Items, as well as other additional services, must be paid for at the time of purchasing in store or remotely3.
In the case of the kitchen advisor service, the Customer declares that living area of the room, its space and physical layout, are in their final condition. This includes, where appropriate, water and light fixtures being in their final location, and floors and walls having their final finishes.
The products included in the plans, in the quotes or addressed during the advising service do not form part of the advising service and, therefore, may only be purchased in accordance with the usual purchasing system, at the price and under the conditions listed on the date on which the purchase of each product us made, even when the quotes for products provided during the consultation establish different conditions.Likewise, the Advisor Service does not include any Delivery or Assembly Service or any additional service that is not expressly mentioned in these conditions.
As an essential condition for providing the service, the Customer exempts IKEA from any responsibility and, therefore, will be solely responsible for taking into consideration and making use of the products in accordance with the corresponding technical specifications and instructions for use; as well as for verifying the correct location and placement of the product in the product in the property, in accordance with the building book, the obligations for use and maintenance of the property, emergency and evacuation manuals and any other requirements that may emanate from the manuals and regulations that are applicable to the property in question and which IKEA is unaware of and for which the Customer will be solely responsible.
In light of the foregoing, it shall be solely the Customer's responsibility to verify that the design and documentation generated by IKEA meets the conditions of safety, habitability, suitability and other obligations that in their capacity as user, owner, tenant or any other title granting them the legitimacy to provide this service in relation to the property, or if it must be amended by the Customer.
Accordingly, the virtual advisor service provided by IKEA to the Customer is of an informative nature, with it being understood that under no circumstances may the inability of any kind (material, legal, financial, administrative etc.) to bring the project resulting from the service to physical fruition be attributable to IKEA; with IKEA being completely exempt from any kind of responsibility in this regard.
Moreover, delivery by the Customer of the plan of the room subject to the advising service by IKEA, in addition to the corresponding measurements, is fundamental for the adequate provision of service. The Customer accepts responsibility for any measurements, descriptions and information contained, with IKEA exempt from any responsibility should any element of the plan or information provided not correspond to the physical reality (measurements, spaces, layout etc.) of the room.
If any case of force majeure, or a case attributable to the Customer that prevents any of the assumed obligations from being carried out, arises, this shall not imply a non-compliance by IKEA.
All information that is provided by the Customer shall become the property of IKEA, with IKEA holding no responsibility in any way for the veracity, precision or sufficiency of the Information provided between both parties.
5.SERVICE DESCRIPTION
VIRTUAL ADVISOR SERVICE FOR KITCHENS
IKEA will provide a customised remote advisor service for buying kitchens and this will include the design and planning of the IKEA kitchens based on the information provided in the survey that the Customer has completed during the appointment booking process, as well as the plan supplied by the Customer, which is essential for the adequate provision of service.IKEA will not provide the design and planning service for kitchens that do not entirely consist of IKEA products.
IKEA will send the Customer automatic confirmation of the specific time and date that the service will be provided.The Customer must send IKEA the blueprint for the area that is the subject of the consultation, with the corresponding dimensions, as an image file (JPG, PNG etc.) to the address provided by IKEA prior to the appointment.
This is a one-time service, provided during a single remote meeting on the date and by remote means agreed by both parties, with a duration up to 90 minutes, depending on the type of appointment, unless agreed otherwise with the Customer.
After the telephone or remote session, the outcome of the service will be verified by delivering to the Customer, within a maximum of 7 days of the date of the session, a proposal with a 3D plan and a quote, both in PDF format, the delivery of which will absolve IKEA of any other obligations or responsibilities.
With regard to this kitchen advisor service, IKEA offers the Customer the possibility of requesting assistance from the Verification Service to take measurements. The Customer may add this on for a fixed amount of EUR 40, regardless of whether the Customer ultimately decides to purchase a kitchen at IKEA.However, if the Customer ultimately purchases the IKEA kitchen after contracting said planning service, this amount will be discounted from the price of the kitchen.
In the event that the kitchen installation is being contracted with an external partner company, said company will carry out a verification of the kitchen prior to the kitchen installation, unrelated to IKEA, to check that the design is properly adapted to the Customer's kitchen.
VIRTUAL ADVISOR SERVICE FOR BEDROOMS
IKEA will provide a customised remote advisor service for buying bedrooms and this will include the design and planning of the IKEA bedrooms based on the information provided in the survey that the Customer has completed during the appointment booking process, as well as the plan supplied by the Customer, which is essential for the adequate provision of service.IKEA will not provide the design and planning service for bedrooms that do not entirely consist of IKEA products.
IKEA will send the Customer automatic confirmation of the specific time and date that the service will be provided.The Customer must send IKEA the blueprint for the area that is the subject of the consultation, with the corresponding dimensions, as an image file (JPG, PNG etc.) to the address provided by IKEA prior to the appointment.
This is a one-time service, provided during a single telephone or remote meeting on the date and by remote means agreed by both parties, with a duration up to 60 minutes, depending on the advisory needs of Customer.
After the telephone or remote meeting, the outcome of the service will be verified by delivering to the Customer, in the case of an entire bedroom and within a maximum of 7 days of the date of the meeting, a proposal with a 2D floor plan (as viewed from above) and a quote, both in PDF format; and in the case of wardrobes, two images from the IKEA planner and a quote in PDF format; the delivery of which will exempt IKEA of any other obligations or responsibilities.
VIRTUAL ADVISOR SERVICEFOR LIVING ROOMS
IKEA will provide a customised remote advisor service for buying living rooms and this will include the design and planning of the IKEA living rooms based on the information provided in the survey that the Customer has completed during the appointment booking process, as well as the plan supplied by the Customer, which is essential for the adequate provision of service.IKEA will not provide the planning and design service for living rooms that do not entirely consist of IKEA products.
IKEA will send the Customer automatic confirmation of the specific time and date that the service will be provided. The Customer must send IKEA the plan of the area subject to the advisor service, with the corresponding measurement, in an image format (JPG, PNG etc.) via the address that IKEA provides to them prior to the appointment.
This is a one-time service, provided during a single telephone or remote meeting on the date and by remote means agreed by both parties, with a duration up to 60 minutes assigned by IKEA, depending on the advisory needs of Customer.
After the telephone or remote meeting, the outcome of the service will be verified by delivering to the Customer, in the case of an entire living room and within a maximum of 7 days of the date of the meeting, a proposal with a 2D floor plan (as viewed from above) and a quote, both in PDF format; and in the case of wardrobes, two images from the IKEA planner and a quote in PDF format; the delivery of which will exempt IKEA of any other obligations or responsibilities.
VIRTUAL ADVISOR SERVICE FOR BATHROOMS
IKEA will provide a customised remote advisor service for buying bathrooms and this will include the design and planning of the IKEA bathrooms based on the information provided by Customer, as well as the plan supplied by the Customer, which is essential for the adequate provision of service. IKEA will not provide the bathroom design and planning service for bathrooms comprised entirely of non-IKEA items.
IKEA will send the Customer automatic confirmation of the specific time and date that the service will be provided.The Customer must send IKEA the blueprint for the area that is the subject of the consultation, with the corresponding measurements, as an image file (JPG, PNG, etc.) to the address provided by IKEA prior to the appointment.
This is a one-time service, provided during a single remote meeting on the date and by the remote means agreed by both parties, with a duration of up to 45 minutes depending on the type of appointment.
After the telephone or remote meeting, the result of the service will be verified by delivering to the Customer, within a maximum of 7 days from the date of the meeting, a design with a 3D blueprint and a quote, both in PDF format, the delivery of which will exempt IKEA from any other obligations or responsibilities.
PRICE AND PAYMENT
The Customised Remote Advisor Service is free with respect to the design of the room (kitchen, bedroom, living room or bathroom); the Verification Service for kitchens is not free, per the terms stated in the corresponding section.
With regard to payment by the Customer for the aforementioned service, the following are accepted: online payment through customer services, or payment in any of our IKEA stores.
The products included in the plans, quotes or addressed in the consultation do not form part of the Advisor Service, and are not included in the price under any circumstance. Therefore, they can only be acquired in accordance with the usual purchasing system, at the price and under the conditions listed on the date on which the purchase of each sale is made, even when the quotes for the products provided during the consultation establish different conditions.
IKEA will enable the Customer to acquire services in addition to their purchase, such as the delivery and installation service, which the Customer must purchase from external partner companies, in accordance with the conditions agreed with said partner companies.
AFTER-SALES SERVICE
In the event that the Customer has a problem with the purchase of the service, they should contact the store of their choice.Moreover, they may contact IKEA Customer Service by phoning +34 900 400 922 between 8 a.m. and 10 p.m. from Monday to Saturday, and between 10 a.m. and 8 p.m. on Sundays and public holidays.
GUARANTEE
IKEA will respond to product non-conformities within three years from the date on which the Customer purchases the product, or of its delivery by external partner companies, per Spanish Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the Ley General para la Defensa de los Consumidores y Usuarios (Spanish consumer protection law) and other complementary laws.
The METOD kitchen system has specific commercial guarantee conditions, whereby said guarantee is only valid when the kitchen is used domestically and for certain components.
The guarantee is valid for a period of 25 years, and covers the following components only: •Cabinet frames•Fronts•Wall rails•UTRUSTA hinges•MAXIMERA fully removable drawers•UTRUSTA tempered glass and melamine shelves•Plinths•Legs• Door dampers•Push openers for doors •Cover panels•Deco strips/moulding•Countertops•Wall panels • Sinks (excluding FYNDIG).

CANCELLATION OF THE VERIFICATION SERVICE
The verification service cannot be cancelled once the service has been provided in full; when the service has begun, with the express prior consent of the Customer and with acknowledgement from the Customer that the Customer is aware that, once the service has been provided in full by IKEA, it may no longer be cancelled.
The Customer acknowledges having been informed that, following initiation of the verification service with the Customer's consent and once the service has been provided in full, the Customer may no longer cancel the service provided.
APPLICABLE LEGISLATION.SUBMISSION TO JURISDICTION
These conditions will be governed by applicable Spanish legislation, for any aspects that are not provided for under it in terms of interpretation, validity and implementation.
The parties undertake to submit any dispute that may arise with regard to the interpretation or execution of these contractual conditions to the courts and tribunals of the city corresponding to the home address of the Customer.
