Terms and conditions of the personalised projects service for business

This document regulates the general terms and conditions for using the INTERIOR DESIGN SERVICE FOR BUSINESS in the two options, PROJECT (PREMIUM) and/or CONSULTATION (BASIC) either IN PERSON (only available at selected IKEA stores) OR VIA VIDEOCONFERENCE (hereinafter, the “INTERIOR DESIGN SERVICE” or the “SERVICE”) between IKEA IBÉRICA S.A.U., with registered office at 9 Avenida Matapiñonera, 28703, San Sebastián de los Reyes, Madrid, Spain and with CIF (tax ID no.) A28812618 (hereinafter “IKEA”) and the customer (hereinafter the “Customer”).

ONE. – SERVICE DETAILS

If you need our help decorating any of your business’ rooms, you can contract this INTERIOR DESIGN SERVICE FOR BUSINESS through our website in any of the options offered: PROJECT (PREMIUM) OR CONSULTATION (BASIC).

The INTERIOR DESIGN SERVICE FOR BUSINESS is priced as follows:

  • PREMIUM INTERIOR DESIGN PROJECT SERVICE FOR BUSINESS: ONE HUNDRED AND FIFTY EUROS (EUR 150) up to 201 square metres (m2) plus FIFTY CENTS (EUR 0.50) per additional m2.
  • BASIC INTERIOR DESIGN CONSULTATION SERVICE FOR BUSINESS: FIFTY-NINE EUROS (EUR 59).

IMPORTANT! If you are a Customer that has signed up to the IKEA for Business Network, please consult the special prices for the services listed above, since as a member of this IKEA for Business Network, you will be able to enjoy benefits, discounts and other exclusive offers from IKEA.

The SERVICE includes the following:

  • PREMIUM INTERIOR DESIGN PROJECT SERVICE FOR BUSINESS:
    • Design project with 3D plans and quotes
    • Our consultants will help you choose your furniture and accessories
    • We’ll help you through the purchase process and with preparing your order
  • BASIC INTERIOR DESIGN CONSULTATION SERVICE FOR BUSINESS:
    • We’ll advise you on choosing your furniture and accessories
    • We’ll help you through the purchase process and with preparing your order

Once you request the SERVICE that best suits your needs, you will be able to book your appointment date and proceed with the payment on the website.

For the PREMIUM INTERIOR DESIGN PROJECT SERVICE FOR BUSINESS, it will be possible to arrange and pay the price of the service for the first 201 m2 on the website. If your business has more m2, the information, contract and payment for additional rooms will be provided prior to the SERVICE being performed and is to be done as follows: after you request the SERVICE, you will receive a phone call from IKEA requesting the information required for the service to be properly carried out, such as plans, photos etc. as set out in these conditions; through this phone call, you will be able to express your interest in contracting the SERVICE for the additional m2; you will then receive an email from IKEA with a link through which you can pay for those additional m2 before the SERVICE is performed.

Payment constitutes full and unreserved acceptance of these terms and conditions.

Under no circumstance may payment be made in cash. Accepted payment methods include PayPal or VISA and Mastercard credit or debit cards, refund cards and gift cards.

The Customer will have until 23:59 of the day on which they request the SERVICE and, in the case of additional m2, until 23:59 of the day on which the payment link is sent to make the payment through this link. In the event that the Customer does not make the payment by the above deadline, the Customer will be deemed to have withdrawn their request for the SERVICE and the request will be cancelled. As such, the Customer will have to start the process again, if they so require. Once the booking has been made, we will contact you again by phone call, email or any other appointment management tool introduced by IKEA for the SERVICE, we will inform you of the documentation that we will need and, should you choose the video conferencing option, we will send you a Teams (video conferencing platform) invite link through the app or tool that IKEA introduced to manage SERVICE appointments, with the agreed day and time.

In the event that the Customer does not provide IKEA with the necessary documentation required by IKEA for the SERVICE to be properly performed at least 72 hours in advance of the video call or appointment, the Customer will be deemed to have withdrawn their request, the appointment or video call will not be held, and IKEA will refund the amount paid for the SERVICE within a maximum of 14 calendar days. If the Customer does not expressly accept the call for the appointment or video call, or contact IKEA to change the date and/or time of the call at least 24 hours in advance of the video call or appointment, the Customer will be deemed to have withdrawn their request and the appointment or video call will not be held, and IKEA will refund the amount paid for the SERVICE within a maximum of 14 calendar days.

If the Customer has accepted the call or appointment but does not respond to the call at the scheduled time of the appointment or attend the store at the agreed date and time and, as a result, the SERVICE could not be provided for this reason or for any other reason attributable to the Customer, the Customer must make a new SERVICE request by paying IKEA the corresponding amount again. If the video call or in-person appointment is not held at the agreed date and time for reasons attributable to IKEA, a new appointment or call will be scheduled for the Customer for another date and time and the amount paid for the SERVICE will be refunded, i.e. the SERVICE will be provided free of charge.

The Customer can cancel or postpone the appointment or video call up to 48 hours before the SERVICE is performed at no extra cost, by contacting IKEA by email or telephone. IKEA also reserves the right to change the date and time of the appointment or video call, without incurring any penalty, as long as IKEA notifies the Customer at least 48 hours in advance of the proposed time for the appointment or video call.

Prior to the in-person or video conference appointment, we will need you to send us the requested information so that we can prepare for the appointment as much as possible. The minimum requirements are: room measurements and plans with measurements are to be provided to IKEA by the Customer. It is also advised that you send photos of the room(s) you want to decorate, ensuring that no persons appear in such photos. The in-person or video call appointment will be held in order to be able to perform the SERVICE for the room (or rooms) in question.

The Customer must follow the directions provided by IKEA and must ensure that no natural persons and/or third parties, particularly minors, appear in video calls. IKEA shall be exempt from liability if this occurs. IKEA will not record or store video calls, however the Customer accepts that by contracting the SERVICE, they have given their permission for the space to be recorded that is the subject of the SERVICE.

You will need to consider the following aspects for this SERVICE to be carried out successfully:

  • You must have access to a mobile phone or laptop with a camera
  • Have internet at the address where the service is to be performed (4G /WIFI)
  • Have a tape measure. We recommend a 5–8 m retractable tape measure.

The maximum duration of the video call or in-person appointment will be 90 MINUTES. During this time, the INTERIOR DESIGN SERVICE FOR BUSINESS will be provided for all the rooms in question.

After the in-person appointment or video call has ended, if the requested service is the PREMIUM INTERIOR DESIGN PROJECT FOR BUSINESS, we will send the project to the email address that you used to contact us, within FOURTEEN (14) working days.

If the selected service is the BASIC INTERIOR DESIGN CONSULTATION FOR BUSINESS, we will send you the quote along with the solution within SEVEN (7) working days.

Once the Project for the SERVICE has been sent to the Customer (which will include a quote for IKEA merchandise in each case), the SERVICE will be considered finished. Consequently, once the SERVICE has ended, any customer contact with IKEA relating to, or as a result of, the customer changing their opinion, having additional questions, requesting the SERVICE for other rooms, or similar, will be considered as a new INTERIOR DESIGN SERVICE FOR BUSINESS request and as such, the Customer must pay the price of this SERVICE as per the conditions set out in this document.

Customers are hereby informed that they may use the email address provided by IKEA for the purposes of the INTERIOR DESIGN SERVICE FOR BUSINESS solely and exclusively to send any information requested of them by IKEA in connection with the aforementioned INTERIOR DESIGN SERVICE FOR BUSINESS, as well as to arrange the details of the appointment or video call. Any other communication from the Customer to IKEA sent to this email address for a purpose other than that specified above, or any communication sent by the Customer after the SERVICE has been provided, will not be answered.

Customers are also hereby informed that if, following completion of the INTERIOR DESIGN SERVICE FOR BUSINESS, the Customer ultimately chooses to purchase goods from IKEA and contract transport, assembly and installation services with IKEA, the Customer must sign the corresponding service contract. For kitchens, this contract also includes the obligation for the Customer to contract the verification/measurement service prior to any kitchen being assembled. The Customer will be informed of the price of this service prior to the service being contracted. If a verification is performed for the Customer and the Customer ultimately chooses not to contract the kitchen installation service, IKEA will charge for the verification/measurement service performed; if the Customer changes their mind and those changes imply a second or successive verification/measurement, IKEA will charge for the new verification service. If the Customer then contracts the installation service, IKEA will refund the Customer for the first verification and only charge for the final verification. The kitchen to be measured or installed by IKEA must be under construction and must have electricity and running water so that the installation can be checked.

TWO. – INFORMATION, USE OF IMAGES AND ASSIGNMENT OF INTELLECTUAL PROPERTY RIGHTS 

In connection with the SERVICE, the Customer may provide IKEA with information and photos of the room(s) in question. The Customer shall, under all circumstances, refrain from including personal images in which natural persons appear, whether of the Customer themselves or a third party. Accordingly, IKEA will not use images in which natural persons appear in connection with this SERVICE and will immediately delete them in the event that they are received from the Customer. If the deletion of such images results in an inability on the part of IKEA to properly provide the SERVICE, IKEA reserves the option not to provide the SERVICE to the Customer.

Intellectual and industrial property rights, including copyright and the design of all audio-visual content, as well as all comments, photos and explanations provided by the Customer to IKEA in connection with the SERVICE, shall belong to IKEA from the moment they are provided by the Customer. This content, as well as the Project provided by IKEA, may be used, published and/or reproduced by IKEA or the IKEA GROUP worldwide for an unlimited amount of time through any form of internal or external action, for commercial, advertising, promotional, publication and/or informational purposes for the SERVICE and/or to document the provision of the SERVICE, including, but not limited to, through media, television, direct marketing, the internet, web pages, social media or any other means, in whatever form this may take. The Customer will not be entitled to any remuneration or compensation whatsoever on account of the matters contained in this paragraph. 

The Customer may not disclose the Project obtained from the SERVICE in any way or through any means. 

THREE. – LIABILITY

Once IKEA has sent the Project to the Customer, IKEA will not have any further obligations or liabilities. The Project merely reflects the opinion of IKEA; as such, IKEA assumes no liability in connection with the use made of its interior design advice or any damages that may be suffered by a Customer who enters into any transactions by reference to the interior design advice under the SERVICE.

The Customer acknowledges that all products sold by IKEA are intended for domestic use and have undergone testing in accordance with applicable regulations and standards. The guarantees offered by IKEA on its products cover domestic use. Although some IKEA items are recommended for domestic-professional use, not for use in institutions or public administrations, the Customer must, in each case and prior to purchasing an IKEA product, ensure that it is legally fit for its intended use. For this purpose, product data sheets are available for consultation at IKEA stores and at www.ikea.com/es/en. IKEA assumes no liability for any potential claims arising from a use other than that for which the IKEA item is intended or for its installation or placement. The Customer releases IKEA from any liability and, therefore, will be solely responsible for taking into consideration and making use of any IKEA products ultimately purchased, in accordance with the technical specifications and corresponding instructions of use, as well as for verifying the correct location and placement of the product in the Customer’s home, in accordance with the building book, the obligations for use and maintenance of the property, emergency and evacuation manuals and any other requirements that may emanate from the manuals and regulations that are applicable to the Customer’s home, which are matters not known to IKEA and for which the Customer will be solely liable.

All information that is provided by the Customer, which must be valid and accurate, shall become the property of IKEA, without IKEA assuming any liability for the accuracy, precision or sufficiency of the information provided between the two parties.

The Customer releases IKEA from any third-party claims arising from the Customer’s failure to comply with any warranties granted by the Customer under these terms and conditions.

If an event of force majeure or any reason attributable to the Customer prevents IKEA from carrying out any of the obligations it has assumed under these terms and conditions, this shall not constitute or result in a breach by IKEA.

FOUR. – MODIFICATION AND TERMINATION OF THE SERVICE

IKEA reserves the right, at any time and without prior notice, to modify these Conditions of the INTERIOR DESIGN SERVICE FOR BUSINESS and to update, modify or remove any provisions through the publication of new Conditions to replace these Conditions in order to make them known to customers at any given time. IKEA reminds customers of their obligation to carefully read the Conditions of the INTERIOR DESIGN SERVICE FOR BUSINESS made available to them at any given time, with the acceptance of these terms always constituting an essential step prior to contracting the INTERIOR DESIGN SERVICE FOR BUSINESS. Furthermore, IKEA may stop providing this INTERIOR DESIGN SERVICE FOR BUSINESS at any time, informing customers that the service is no longer active or available. IKEA assumes no liability for damages of any kind that may arise from it exercising these powers. 

FIVE. – GOVERNING LAW AND FORUM

Any discrepancies that may arise in relation to the interpretation of and/or compliance with these terms and conditions shall be resolved in accordance with Spanish law and any disputes shall be settled before the Courts and Tribunals of Madrid.

SIX. – CAPACITY AND ACCEPTANCE OF THESE TERMS AND CONDITIONS

The Customer states that they have the necessary and sufficient legal capacity to use the SERVICE in accordance with these terms and conditions, which the Customer understands and accepts in full and without reservation. Simply requesting and paying for the SERVICE entails the complete and unreserved acceptance of, and adherence by the Customer to, these terms and conditions.
