User-Generated Content Terms and Conditions  

About these Terms and Conditions 

These terms and conditions (“Terms”) apply to our use of any words, pictures, images, data, information or any other ‘user-generated content’ that you upload, post or share (“Content”)  using third-party websites or platforms including but not limited to Instagram, Facebook, Pinterest, YouTube, Snapchat and Twitter (the “Third Party Platforms”) and which we use on our website or in other marketing channels or in any IKEA owned social media platforms (“IKEA Media”). If the Content contains any personal information, IKEA will handle such data in accordance with our Privacy policy, as described below.

IKEA/we/our/us in these Terms refer to IKEA North America Services, LLC, located at 420 Alan Wood Road, Conshohocken, PA 19428, USA.

Our Use of the Content

  1. From time to time, we, along with our authorized service providers, select Content in Third Party Platforms that we would like to use in IKEA Media.
  2. The Content selected and used by us will be in accordance with these Terms.
  3. In order to be selected as a participating contributor, you must be aged 16 years or over and have access to a valid and genuine Third-Party Platform account.
  4. You do not need to purchase anything from IKEA in order to contribute Content to IKEA Media.
  5. If we would like to use your Content in any IKEA Media, we will contact you on the relevant Third Party Platform to ask for your Consent to use your Content. We will ask you to reply to us with the hashtag “#hejikea” if you agree to allow us to use your Content in IKEA Media.  
  6. You must respond directly to us within the same chat, thread, comment section or by private message, which must include the hashtag “#hejikea” (your "Consent") in order to permit us to use the Content as described in these Terms. If we do not receive your response within seven (7) days from the date we contacted you, we will assume that you do not consent and your Content will not be used by us in any IKEA Media.
  7. Once you have given your Consent, you agree to be bound by these Terms as well as the terms of use of any relevant Third Party Platform, which can be found on that platform’s website.
  8. By giving your Consent, you:
    a. grant IKEA and its affiliates a non-exclusive, worldwide, transferable, royalty-free, irrevocable, perpetual right and license without compensation to use your Content as set out in these Terms;
    b. represent and warrant that your Content is your original creation and not copied from third parties;
    c. are directing IKEA to share your Content with third parties without receiving renumeration, including in public marketing/advertising and/or on social media,
    d. acknowledge that your Content may appear on IKEA Media;
    e. represent and warrant that you have all the rights necessary to allow us to use your Content, including, without limitation, that you have the right to use the account or username from which the Consent was granted);
    f. represent and warrant that the creation and use of your Content in any IKEA Media complies with all applicable laws and regulations;
    g. represent and warrant that your Content does not infringe or otherwise violate the copyright, trademark, trade secret, publicity, privacy or other intellectual property or other rights of any third party and that your Content is free from viruses and other malware;
    h. waive all rights to inspect or approve any Content prior to its use in IKEA Media;
    i. release and discharge IKEA from any claim, demand, cause of action, compensation, fees or damages, for defamation, invasion of privacy, publicity, or for any similar matter based upon or relating to IKEA’s use of your Content; and
    j. waive any moral rights, rights of attribution, authorship rights, rights to object to modification, and any similar rights you may have in your Content, such as any right you may have to be named as the author of the Content or to protect the integrity of your Content.
  9. You give us your permission for us to redesign, archive, reproduce, disseminate, display, publicly perform and/or replay and make publicly accessible, as well as to cut and edit, adapt, modify, create derivatives works of, and otherwise exploit your Content or any part of it.
  10. If your Content is corrupted, inappropriate, illegible, or otherwise not in accordance with these Terms then we will not accept your Content.
  11. You accept that IKEA has no obligation to use your Content even if we request to use your Content.  IKEA may choose not to use your Content or to remove your Content from any IKEA Media at any time.  
  12. You agree that you will not receive any payment or other remuneration if we use your Content in any IKEA Media.
  13. You may withdraw your Consent at any time by contacting our Customer Service Contact Center at 1-888-888-4532.  Please give IKEA five (5) business days to process your request.
  14. If you remove any of the Content you released to us from the Third Party Platform it was originally posted on, then it will be removed from the IKEA Media only where your and our Third Party Platforms are linked, subject to reasonable delays for technical reasons. If your Content is used by us on Third Party Platforms which are not linked and as a result your Content is not removed from the IKEA Media as a result of you removing it from a linked Third Party Platform, and you would no longer like your Content to be posted on the relevant IKEA Media, then please contact our Customer Service Contact Center to notify us of your request. Please give IKEA five (5) business days to process your request. Once your request is processed, we will remove your Content within a reasonable timeframe.
  15. To the extent it is permitted by law to do so, we accept no liability for any damage, injury or loss suffered due to our use of your Content or our failure to remove your Content per these Terms.
  16. We will only use personal information supplied by you for the purposes of posting your Content unless you provide your Consent for us to use your personal information for any other agreed purpose.
  17. IKEA reserves the right to modify these Terms at any time without notice, and such changes shall be deemed effective immediately upon posting of the modified Terms. You should regularly review these Terms to ensure that you are aware of, understand and accept any changes made. The version of the Terms in force at the date you provide your Consent will apply to your Content.
  18. These Terms are governed by the law of the Commonwealth of Pennsylvania and any disputes in relation to them are subject to the exclusive jurisdiction of the state and federal courts in the Commonwealth of Pennsylvania.

 

Our Privacy Notice

The Content we collect from you may contain your personal information, including your username on Third Party Platforms, photographs, and any personal information contained in the text you include with your post on Third Party Platforms.  We collect, use and share the personal information we collected from the Content in accordance with our Privacy Policy, which is available at https://www.ikea.com/us/en/customer-service/privacy-policy/. Our Privacy Policy also contains instructions on how you can exercise your data privacy rights under applicable laws.
