IKEA FREE WI-FI ACCESS TERMS AND CONDITIONS

This is a free, non-public, wireless “hotspot” internet service (the “Service”) provided by IKEA North America Services, LLC and its parents, affiliates, and/or franchisors (collectively, “IKEA”. we,” “our,” or “us”) for use by customers, co-workers, and guests of IKEA while they visit our store(s) located in the United States.  The Service may not be available in all IKEA locations in the United States and may not be accessible from all devices. All users are required to accept these IKEA FREE WI-FI ACCESS TERMS AND CONDITIONS (the “Terms”) to use the Service.

By clicking the “I ACCEPT” button on IKEA’s WI-FI landing page, connecting to this wireless network, and utilizing the Service, you agree that you are of legal age and that you have read, understood, and agree to be legally bound by the Terms. By using the Service, you agree to the Terms and Conditions of IKEA, as modified by these additional terms. Any reference to “Services” in the IKEA Terms and Conditions will be deemed to include the Service. In the event any terms in the IKEA Terms and Conditions conflict with these additional terms, these additional terms will control. All capitalized terms not defined in these Terms have the respective meanings set forth in the IKEA Terms and Conditions.

By electing to use the Service you are responsible for compliance with all local laws, rules, and regulations. IKEA does not guarantee the availability or functionality of the Service at any time.  IKEA reserves the right to modify, suspend or discontinue the Service, in whole or in part, at any time and in its sole discretion. There is no guarantee of availability or functionality at any time, and your access to the Service shall be at the complete discretion of IKEA.  Access to the Service may be blocked, suspended, or terminated at any time for any reason including, but not limited to, technical problems, violation of this Agreement, actions that may lead to liability for IKEA, disruption of access to other users or networks, and violation of applicable laws or regulations.

Privacy and Security

Privacy and security are important to IKEA. By accepting these Terms you are also accepting the terms of the U.S. Privacy Policy, which are incorporated herein by reference for all applicable purposes. Please read the U.S. Privacy Policy for information on how we collect, use, and disclose your personal information.There are privacy and security risks associated with connecting to the Internet over wireless communications. IKEA reserves the right to monitor and collect information while you are connected to the Service, including but not limited to your device media access control (MAC) address and information concerning your activities during transmission and in connection with use of this Service, and that the collected information can be used at the discretion of IKEA in compliance with this Privacy and Security section. IKEA cannot assure that your activities will be private or secure during your use of the Service. You do not have an expectation of privacy or confidentiality when using the service.

When you use the Service, our service provider will process and retain your MAC address on our behalf for up to 5 hours from the time you disconnect from the Service.  You may opt-into the retention of your MAC address for one (1) year so that your device will be recognized each time you visit us. Your device MAC address will be stored for one year and one day from your last visit, after which it will be deleted permanently. If you return to an IKEA location after this period, you will need to login again. If you change your mind and no longer want to use the MAC authentication within that one (1) year period, please write to [email protected]. 

Your use of the Service will be associated with your device MAC address and IKEA may use such analytics to improve wireless coverage, the Service, and venue design to further improve the WI-FI experience. 

Service Disclaimer

Use of the Service is at your own risk. There are privacy and security risks associated with connecting to the Internet over wireless communications. The Service is not encrypted or secured in any way, and any material or other communications that you transmit or receive using the Service may be accessible to third parties. While using the Service, you assume full responsibility and risk for: (i) your own privacy and security; (ii) implementing any safeguards you deem to be appropriate to protect and secure your privacy and systems (such as randomizing or anonymizing your MAC address on your device); and (iii) evaluating the suitability, appropriateness or legality of any informational content or other materials you may encounter online.

The Service is subject to unavailability, including emergencies, third-party service failures, transmission, equipment or network problems or limitations, interference, signal strength, and maintenance and repair, and may be interrupted, refused, limited or curtailed by at any time and for any or no reason. We are not responsible for data, messages or pages lost, not delivered, delayed or misdirected because of interruptions or performance issues with the Service or communications services or networks or damage to your device from using the Service.

You are responsible for providing the equipment required to access and use the Service, such as a smart phone or tablet with wireless connectivity or capability. You are responsible for ensuring your equipment is compatible with the Service. The availability and performance of the Service is subject to your equipment’s memory, storage and other limitations. The Service is intended to support general web browsing activities. Due to limited bandwidth and to ensure a consistent experience for all customers, the Service does not support high-bandwidth actions such as streaming music, streaming video or downloading large files. We reserve the right to limit your use of the Service with respect to bandwidth and data usage as well as session limitation if in our opinion your usage of the Service is excessive.

Prohibited Use

You shall not use the Service to transmit or receive any material or any other communications, which:

  • IKEA deems in its sole discretion are prohibited;
  • are unlawful, malicious, fraudulent, harassing, obscene, indecent, defamatory, threatening, intimidating, tortious, or harmful to IKEA, its guests, or any other party; 
  • contain any pornographic material;
  • contain offensive or derogatory images regarding sex, race, religion, color, origin, age, physical or mental disability, medical condition or sexual orientation;
  • contain material which infringe third party’s rights (including intellectual property, privacy, or other rights (including by intercepting, collecting, or harvesting any material or other communications transmitted or received by other users of the Service);
  • in our reasonable opinion may adversely affect the manner in which we carry out our work;
  • access illegally or without authorization computers, accounts, equipment, or networks belonging to IKEA or another party, or attempt to penetrate the security measures of another system. This includes any activity that may be used as a precursor to an attempted system penetration, including, but not limited to, port scans, stealth scans, or other information gathering activity; or
  • distribute, transmit, or receive any internet viruses, worm, trojan horses, time bomb, spyware or other computer code, file or other destructive software that is harmful or invasive or may or is intended to damage or hijack the operation of, or to monitor the use of, any hardware, software or equipment.

IKEA has the right (but not the obligation) at any time and at its sole discretion to block inappropriate material, websites or other resources, and or may terminate or suspend an individual’s access to the Service for engaging in these prohibited uses, or for any other reason or no reason at all.

Limitation of Liability

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL OR EQUITABLE THEORY, WHETHER IN TORT, CONTRACT, STRICT LIABILITY OR OTHERWISE, SHALL IKEA OR ANY OF ITS AFFILIATES, SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, VENDORS, OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY NATURE ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE SERVICE, OR FOR ANY INFORMATION, PRODUCTS, SERVICES, OR OTHER NETWORKS ACCESSED OR OBTAINED THROUGH THE SERVICE INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, LOSS OF DATA, LOSS OF PRIVACY, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER OR FAILURE OR MALFUNCTION, EVEN IF AN AUTHORIZED REPRESENTATIVE OF IKEA HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. THIS DISCLAIMER APPLIES WITHOUT LIMITATION, TO ANY DAMAGES OR INJURY ARISING FROM ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUSES, FILE CORRUPTION, COMMUNICATION-LINE FAILURE, NETWORK OR SYSTEM OUTAGE, DATA THEFT OR DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, LOSS OR USE OF ANY RECORD OR DATA, AND ANY OTHER TANGIBLE OR INTANGIBLE LOSS. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT IKEA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DEFAMATORY, OFFENSIVE, ILLEGAL, OR OTHERWISE INAPPROPRIATE OR OBJECTIONABLE CONTENT MADE AVAILABLE VIA THE SERVICE, OR CONDUCT OF ANY USER OF THIS SERVICE. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY OF THE ABOVE CLAIMS OR ANY DISPUTE WITH IKEA IS TO IMMEDIATELY DISCONTINUE USE OF THE SERVICE.  BECAUSE SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, ALL OR A PORTION OF THE ABOVE LIMITATIONS MAY NOT APPLY.

Miscellaneous

IKEA reserves the right to change these Terms at any time without prior notice, and such changes will be effective immediately upon being posted. Each time you use the Service, you should review the current Terms. To tell when the most recent updates were made, see the last updated date at the top of the Terms. Your continued use of the Service will indicate your acceptance of the current Terms.

If any provision of these Terms is found to be unlawful, void or for any reason or unenforceable, the remaining provisions remain in full force and effect. No waiver by either party of any breach or default hereunder will be deemed to be a waiver of any preceding or subsequent breach or default.
