General Terms and Conditions for the Production of Custom Worktops

1. Introductory Provisions

IKEA Česká republika, s. r. o. is a member of the IKEA Group and in its stores offers customers furniture and a wide range of home accessories, including services.To this end, IKEA Česká republika, s. r. o., having its registered office at Skandinávská 131/1, Třebonice, 155 00 Praha 5, registration number: 27081052, incorporated by entry in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 94828, issues these GeneralTerms and Conditions for the provision of services to customers, which regulate the basic terms and conditions for the provision of individual services.

These General Terms and Conditions (hereinafter referred to as the "GTCs") for the ordering of Custom-made Worktops are effective as of 1 April 2023 and replace the previous version of these Terms and Conditions.

IKEA reserves the right to amend these GTCs for the manufacture of worktops at its sole discretion. Amendments to these GTCs will not apply to orders for services placed prior to the date on which such amendment takes effect.

These GTCs are governed by Act No. 89/2012 Coll., the Civil Code, and are an integral part of any Contract for Work concluded between IKEA Česká republika, s. r. o. (hereinafter referred to as the "Company") and its customers relating to goods and services purchased by the customer from the Company (hereinafter referred to as the "Customer"). By paying the Order, the Customer confirms that he/she has been informed of the content thereof and accepts it unreservedly.

On the basis of the Order, the Company and the Customer enter into a contract for work in the Company's store or remotely (hereinafter referred to as the "Service").

The company orders the production of custom-made worktops from its contractual partners DESK - FORM a. s. and DanForm GmbH & Co. KG.

Assembly and installation is carried out by the Company through its employees for the IKEA Ostrava and IKEA Brno department stores or its contractual partner (hereinafter referred to as the "Contractual Partners "), TECHWOOD DESIGN s.r.o., Butra Group, s.r.o., UNITECH Professional, s.r.o. and Supersoused.cz, for IKEA Prague-Černý Most and IKEA Prague-Zličín department stores.

The Customer acknowledges that the Company is the exclusive distributor of the IKEA product range in the Czech Republic and that the Company is not authorised to sell or distribute the IKEA product range for the purpose of the resale or rental thereof by the Customer to third parties (within the scope of wholesaling), whether in the Czech Republic or abroad. By paying for an order, the Customer confirms and declares that the IKEA product range which is the subject of the order is purchased exclusively for the Customer's own use, that the Customer is the end user of the goods purchased from the Company and that these goods will not be the subject of the Customer's business, in particular in the form of the resale or rental thereof to third parties.
Based on the Customer's requirements, the Company will design and draw a custom-made worktop, calculate an indicative price, and provide the Customer with a preliminary plan of the worktop. These designs and calculations are indicative only and do not serve as underlying documentation for the Order.

Prior to placing a binding order for a custom-made worktop, the Customer will ensure that the dimensions of the worktop are accurately measured and plotted on the plan. In view of the fact that there may be minor deviations, the measurements for the custom-made worktop must be taken on kitchen cabinets that have already been assembled. The Customer may commission the Company to take the measurements, or he/she may take them himself/herself. If the measurements are taken by the Company´s Contractual Partner, such measuring will be free of charge for the Customer and the Contractual Partner will be responsible for the correctness of the measurements. If the Customer measures the worktop him/herself, he/she is fully responsible for the measurement of the worktop.

Based on the dimensions supplied by the Contractual Partner or the Customer, the Company will create a final drawing of a custom-made worktop for the Customer. The Customer confirms it by paying for the Order with the final price for the goods and any services. The Customer further acknowledges that, if standard products are combined with custom-made products (worktops, wall panels), the Customer accepts that, due to the different manufacturing process, IKEA does not guarantee that all products will match 100% visually. With custom-made products (worktops/wall panels), this also applies if one order is divided into multiple orders on different dates as a result of additional ordering and/or reordering.

By paying for the Order, the Customer confirms that all the data is correct:

Worktop material, edge type, surface finish with all specifications (lamination direction etc)

Position and size of cut-outs (sink, hob, taps, etc.)

The Customer may decide how to assemble the custom-made worktop

transport and assemble the goods on his/her own

order transport and assembly from the Company's Contractual Partners for a fee as per the valid price list.

The Customer may decide how the custom-made worktop is to be transported. Once the Customer has paid for the Order, the data cannot be altered in any way. By paying for the Order, the Customer confirms that he/she has been informed of all the terms and conditions for the delivery of the custom-made worktop.

The Customer is required to present the Order when paying the price of the worktop at the store checkout. Upon payment, the Customer will receive a receipt. If the Customer pays remotely, the receipt will be sent to the email address provided. Upon receipt of the goods, the Customer is obliged to present the original receipt. If the Customer cancels a signed Order within 24 hours of payment, the price of the goods and services will be refunded in the same manner as it was paid. If the Customer cancels an Order, he/she must do so either in person at the store or by calling the customer service line. If the Customer requests cancellation of the Order after that time limit, he/she will be obliged to pay the Company a contractual penalty equal to the final price listed in the Order. The contractual penalty will be set off against the amount paid on the Order.

The Customer will ensure that no changes to the layout that could affect the installation of the custom-made worktop (e.g. masonry work, tiling, ...) are carried out between the time of the measurements and the installation of the custom-made worktop. If changes to the layout are made, the Company will not be liable if the worktop cannot be installed. The custom-made worktop will be made within 35 business days of the date on which the Customer pays for the Order. As soon as the worktop has been delivered to the Company's store or to the Company's external warehouse, the Customer will be contacted by the Company to collect the goods or, if the Customer has ordered a custom-made worktop with delivery, he/she will be contacted by the Company's Service Partner.

Upon taking receipt of the goods, the Customer is obliged to check that the number of worktops delivered matches the number ordered and that the packaging is not damaged.If there are any issues, the Customer contacts the Customer Service Desk without undue delay.
The price of goods and the price of transport and assembly services are stated in the Company's currently valid price lists, which are available in stores and on the website at www.IKEA.cz, and are indicative only.

The price of a service as stated in the service order is binding on both parties.The price of the goods and the transport service is payable at the store on the day the order is placed. The price of the service for the installation of the custom-made worktop is payable directly to IKEA's Contractual Partner. If the location where a worktop is to be installed falls within the area of the IKEA Ostrava or IKEA Brno store, payment for the service of installing the custom-made worktop is made directly to the Company together with the payment of the worktop and the transport service.
The Company will process the Customer's personal data provided in an Order in accordance with applicable personal data protection regulations in order to fulfil the contract, such being for the period of time necessary to fulfil the contract, to settle any claims made by the Customer on account of defective performance, and if such processing is necessary under the law (inparticular tax regulations). The legal basis of processing is the contract concluded between the Customer and the Company. The recipients of personal data will be the contractual partners of the Company charged with processing the Order.The provision of personal data is required for the conclusion of a contract. If the Customer fails to provide data for this purpose, it will not be possible to process the Order.

The Customer has the right of access to their personal data, the right to rectification and erasure thereof, the right to restriction of processing thereof, the right to data portability, and the right to object to the processing thereof. The Customer may exercise these rights by using the contact details below. The Customer has the right to lodge a complaint with the supervisory authority for the protection of personal data, which is the Office for Personal Data Protection, whose registered office and contact details can be found at www.uoou.cz.
The Company will use the Customer's contact personal data to conduct customer satisfaction surveys and to offer its products and services on the basis that this is in its legitimate interest. The Customer has the right to refuse such communication either when concluding the contract or by using the contact details below. Personal data will be stored for 1 year for the purposes of customer satisfaction surveys.
The Czech Trade Inspection Authority is the authority responsible for supervision. Possible disputes between the Company and the Customer regarding obligations arising from concluded Orders may be resolved out of court. The Czech Trade Inspection Authority is the subject for out-of-court dispute solution (www.coi.cz).
