CANDIDATE/EMPLOYEE PRIVACY NOTICE
IKANO RETAIL MEXICO SA DE CV, IKEA SUPPLY MEXICO SA DE CV (hereinafter referred to as "IKEA MEXICO"), with address located at: Calle Oriente 158, número 440, Piso 3, Local JD-01, Colonia Moctezuma Segunda Sección, Alcaldía Venustiano Carranza, C.P. 15530, Mexico City. IKEA MEXICO, in accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals (hereinafter the "Law") and its Regulations, hereby informs those interested in providing their services to IKEA MEXICO, as well as its present and future employees, of the personal data that will be collected as part of the employee selection process of IKEA MEXICO, and derived from the working relationship between IKEA MEXICO and its employees or potential future employees in the United Mexican States (hereinafter "Mexico"), as well as the purposes of the processing to which the personal data in question will be subjected and the mechanisms to ensure the confidentiality, integrity and availability of such personal data.
For the purposes of this Privacy Notice, "Personal Data" shall mean any information concerning an identified or identifiable natural person; while "Sensitive Personal Data" shall mean those personal data that affect the most intimate sphere of its owner, or whose improper use may give rise to discrimination or entail a serious risk for the owner.
The Personal Data collected by IKEA MEXICO consists of: (i) full name; (ii) date and place of birth; (iii) nationality; (iv) marital status; (v) address; (vi) tax information; (vii) social security number; (viii) educational records; (ix) details of previous employment; (x) landline telephone; (xi) mobile telephone; and (xii) email, (xiii) details and documentation required within the framework of migration laws (citizenship, passport, residence or work permit, among others) (xiv) Professional and Academic Data. Details contained in your job application and resume, education history, professional qualifications; curricular information including the name of the schools and/or colleges where the employee studied, (xv) Employment Information. Previous employment history, compensation and payroll data; salary or base salary, eligibility for bonuses, benefits, details of stock options and other awards, salary reviews and performance evaluations, information required for statutory deductions and administration, identification, user name and email address provided by IKEA Mexico, and (xvi) Third Party Information. Identification of family members and contact information required for the management of beneficiaries, family members and economic dependents. Contact information to identify and contact certain individuals in case of emergency. IKEA MEXICO will refrain from disclosing, distributing and/or marketing the Personal Information to third parties, except for the transfers made to the entities mentioned in this Privacy Notice.
In addition to the Personal Data mentioned above, IKEA MEXICO collects Sensitive Personal Data consisting of: (i) banking data; (ii) data related to beneficiaries and economic dependents; (iii) records and references from previous employment; and (iv) image and voice in photograph and/or video (may be collected by surveillance systems) (v) social security certificate of health status and health data required to comply with applicable law and IKEA Mexico's policies (vi) Financial and Compensation Data. Socio-economic information, compensation, stock ownership information and/or benefits. Payroll and other benefit information.
In the event that you do not agree to give your consent for your Sensitive Personal Data to be processed in accordance with the terms of this Privacy Notice, you must notify IKEA MEXICO at avisodeprivacidadrh@ikano.mx within 5 days of receiving this Privacy Notice.
The collection, use, access, handling, administration, use, disclosure or storage (hereinafter the "Processing") of your Personal Data and Sensitive Personal Data will be carried out exclusively to carry out the employee selection process of IKEA MEXICO and during the time you maintain an employment relationship with IKEA MEXICO, for purposes of managing the respective employment relationship, and to comply with the various legal provisions in force and applicable in Mexico and the policies and procedures of IKEA Mexico.
Your personal data will not be processed for marketing, advertising or commercial prospecting purposes.
Personal Data and Sensitive Personal Data collected by IKEA MEXICO may be subject to transfer within and outside the country with controlling companies, subsidiaries or affiliates under common control of the same group of IKEA MEXICO, for the same purposes of Processing described above, including IKANO RETAIL MEXICO, S.A. DE C.V. AND IKEA SUPPLY MÉXICO, S.A. DE C.V.
Additionally, Personal Data and Sensitive Personal Data may be transferred inside and outside the country to service providers other than IKEA MEXICO, such as recruitment agencies, payroll processors or other services contracted by IKEA MEXICO related to human talent management and any other provider or third party such as banking institutions or governmental authorities, in order to comply with the same purposes of processing described above.
As the owner, you have the right to access your personal data; rectify your personal data when it is inaccurate or incomplete; cancel your personal data, as well as oppose its processing (hereinafter referred to as "ARCO Rights").
You may exercise your ARCO Rights by submitting a written ARCO Rights Request to our Human Resources Department, at the e-mail address hrmexico@ikano.mx. In any case, the ARCO Rights Request must contain the following: (i) name of the holder and address or means to communicate the respective response; (ii) documents proving your identity, or if applicable, that of your legal representative; (iii) clear and precise description of the personal data with respect to which you seek to exercise any of the ARCO Rights; and (iv) documents or elements that facilitate the location of the respective personal data.
The Human Resources Department will process the ARCO Rights Requests it receives, provided that they comply with the minimum requirements set forth in the preceding paragraph. The Human Resources Department will communicate the determination adopted within 20 days from the date on which the ARCO Rights Request was received, in order for such determination to become effective within 15 days from the date of communication of the response to the respective ARCO Rights Request.
Likewise, you may revoke the consent you have given to IKEA MEXICO for the Processing of your Personal Data and/or Sensitive Personal Data. In this regard, it is important to point out that not in all cases your request may be met or the Processing may be concluded immediately, since there may be legal obligations that IKEA MEXICO may have to comply with in order to continue processing your Personal Data and/or Sensitive Personal Data.
To revoke your consent, you must submit a Request for Revocation of Consent to our Human Resources Department, at the e-mail address avisodeprivacidadrh@ikano.mx. The Human Resources Department will process your Request for Revocation of Consent provided that such request contains the following: (i) name of the owner and address or means to communicate the respective response; (ii) documents proving your identity, or if applicable, that of your legal representative; (iii) clear and precise description of the personal data in respect of which you revoke your consent. The deadlines for responding to Requests for Revocation of Consent will be the same as those provided for the exercise of ARCO Rights.
IKEA MEXICO has implemented administrative, physical and technical security measures to safeguard your Personal Data and Sensitive Personal Data from possible security breaches of personal data, such as loss or unauthorized destruction; theft, loss or unauthorized copying; unauthorized use, access or processing; or damage, alteration or unauthorized modification.
