1. This part I of the T&C describes the rules applicable to browsing of our website and using our app. By browsing you acknowledge that following terms apply and your use shall be bound by them:

1.1. Your personal information. You can find more details on how we handle your personal data in our Privacy & Cookie Policy. Please ensure that all the personal data you give to us on our website and app, including your log in credentials, is kept safe, secure, and confidential. To find out more about the cookies and other trackers we use, please refer to our Privacy & Cookie Policy.

1.2. The information on our website and app. We do our best to ensure that our website and app operates properly at all times, but we make no warranties as to the availability or accessibility of our website/ app, and (except as set out here) we shall not be liable for any damages, loss, costs or expenses incurred by you as a result of any lack of availability or accessibility of our website/ app. If our prices are displayed incorrectly, we reserve the right to rectify the prices and not sell you the product at the price you originally saw on our website/app.

1.3. Links and sharing. Any links or opportunities to share (via social media, blogs, and similar sites and communication services) on our website/app are provided solely for your use and convenience. The link does not represent any endorsement or recommendation by us and does not mean that we have any association with the linked website/app. We are not responsible for the content of any websites that are linked to or from our website/app or for the legal consequences of your entering into any contracts with the third parties that provide these linked websites and we do not accept any liability for any loss, damage, expense, costs or liability  incurred by you as a result. Please note that if you do share content onto other platforms, there may be separate terms and conditions connected to the organization that allow you to share.

1.4. Connectivity and other discrepancies. The website and app are provided “as is”. We shall not be liable for any loss, damage, expense, costs, delays or other liability whatsoever (including without limitation any financial losses such as loss of profit) which you may incur as a result of any event beyond our reasonable control (including without limitation any failure of transmission, communication, computer or other facilities or your inability to access the website/app for any reason or any failure, error or delay in the sending or receiving of any notice or communication or instruction through the post or any electronic medium).

1.5. Copyright. The content of all parts of the website/app and IKEA Family name belongs to IKEA. This includes copyright in all of the text, descriptions, and images. It also includes trademarks in our name and logos. You may download to a local hard disk and print extracts from our website/app for your personal use. You may also re-copy downloaded extracts to others provided you do not do so for profit. Reproduction of part or all the contents in any form is prohibited unless for personal use. None of the content of our website/app may be copied or otherwise incorporated into or stored in any other web site, electronic retrieval system, publication or other work in any form (whether hard copy, electronic or other). If you want to use any of our content for any purpose other than as set out above (which includes framing the website/app) you must first contact us and obtain our permission.

1.6. Make sure you are up to date. We reserve the right to change the terms of use described in this part I of the T&C at any time. Any changes will take effect immediately when they are placed on our website/app, and will apply to all future use of our website/app. You should regularly check the T&C and our policies posted on our website/app as they may have changed since your last visit.

1.7. What you cannot do on our website/ app. When using our website/app you cannot: (i) interfere or disable any security related features of the site or features that prevent or restrict use or copying of the content accessible via the site; (ii) give any false information in your account details; (iii) take another person’s identity without that person’s permission or misrepresent you are acting on behalf of a person, entity or organization; (iv) use the site/app if we have suspended or banned you from using it; (v) send junk, spam or repetitive messages; (vi) engage in any illegal or unlawful conduct; (vii) modify, interfere, intercept, disrupt or hack the site/app; (viii) misuse the site by knowingly introducing viruses, Trojans, worms, logic bombs or other similar material or by undertaking any other action which would harm the site/app, any site user’s equipment or have a detrimental impact on any site user’s experience of using the site; (ix) collect any data from the site other than in accordance with these T&C; (x) submit or contribute any content that is abusive, threatening, obscene, untrue, shocking or offensive; (xi) abuse, harm or bully another site user, member of our staff or person; (xii) submit or contribute any user content without the permission of the content owner or otherwise infringe the copyright, trademark or other rights of third parties; or (xiii) submit or contribute any information or commentary about another person which is untrue, private, confidential or defamatory (including personally accusing another person of unproven criminality or serious wrongdoing which could damage their reputation in the eyes of anyone reading your comment).If you breach any of these T&C we may prevent you from using this website/app on a permanent or temporary basis. We can take other actions as well including but not limited to reporting you to the police or other law enforcement bodies, issue a warning or take legal action against you and pursue any costs we incur because of doing this.

2. This part II of the T&C provides rules for registration and IKEA Family account creation; and a list of benefits and rewards which are offered to registered users.

3. You can make purchase and order services on our website /app without a registration using the “Guest” checkout mode. However, if you register and create an IKEA Family account (“Account”) you will have access to certain benefits and rewards which will allow you to have a more convenient shopping experience.

4. To create an IKEA Family Account, you will have to:

4.1. be at least 18 years old, fill-in a registration form available on our website/ app; you shall be responsible for the correctness, secrecy, and (or) maintaining the registration data. If you provide another person’s personal data and/or do not provide accurate registration data and/or fail to update it in time, IKEA Latvia shall not be liable for the consequences subsequently incurred by you or third parties;

4.2. create a password;

4.3. accept these T&C;

4.4. acknowledge our Privacy & Cookie Policy, and

4.5. confirm your Account creation via your email.The Account shall be activated, and IKEA Family benefits and rewards shall be accessible immediately after the Account confirmation from your email is received. A digital IKEA Family card (a QR code) will be automatically attributed to the Account to facilitate easier checkouts. This digital card will also be sent to your e-mail address. Use of your IKEA Family digital card does not constitute proof of purchase.

5. The Account may be closed or suspended, the rewards and benefits accrued shall be suspended or cancelled by providing a notice to your registered email address, if:

5.1. we consider, or have reasons to believe, that your use of the IKEA Family Account is or is likely to be in breach of these T&C;

5.2. we suspect fraud, unauthorized use or abuse of our services, benefits and rewards, or any other use of the IKEA Family Account that we consider not acceptable to IKEA; or

5.3. it was not active for more than 5 years. By inactivity, we mean, for example, that you have not interacted with IKEA Latvia including but not limited to logging in to your Account, placing items in your shopping basket, adding items to your favourite list or making a purchase with IKEA Family card/account.

6. You may delete your IKEA Family Account at any time in the Account settings. If you do so, you will no longer be able to benefit from the IKEA Family benefits and rewards and you will no longer be able to use the IKEA Family card, as it will become inactive. Any benefits or rewards and IKEA Family card accrued at the date of account closing will be forfeited and cannot be redeemed following cancellation.

7. Upon termination/ deletion of the Account, all rights and obligations under these T&C will automatically terminate except for any rights which have accrued up to the date of termination any payment obligations.

8. IKEA Family benefits:

8.1. Insurance of IKEA goods (IKEA Family “Just in case” protection). Registered Account holders have the benefit of insurance for new IKEA products against accidental damage during delivery. Insurance does not apply to: (i) purchases picked, transported, assembled, or installed as part of our additional IKEA services, as they are covered by the service provider, as outlined by their terms and conditions; (ii) cut fabric or goods ordered to your specification, e.g. custom-made worktops; (iii) purchases from Bargain Corner, IKEA Bistro, IKEA Swedish market or IKEA restaurant; (iv) live plants.

8.2. Extended return period. IKEA Family Account holders have 365 days from the date of purchase to return any new and unopened good. This benefit is in addition to the current IKEA returns policy. This benefit does neither affects nor withdraw your statutory rights.

8.3. Favourite list. IKEA Family Account holders can use a “favourite list” functionality allowing them to make a list of items they are interested. Favourite list items are stored in the user’s Account for as long as the Account is active or until the item is removed from the Favourite list or the item is withdrawn and not sold in the Store anymore.

9. These T&C are applicable, and benefits/rewards are valid in the territory of the Republic of Latvia, i.e. IKEA Riga store (Biķeru Street 2, Ulbroka, Stopiņu Parish, Ropaži Municipality, LV-1079 Republic of Latvia), IKEA Liepaja pick-up and ordering point (Ezermalas Street 3C, Liepaja, LV-3401, Latvia, Republic of Latvia).

10. IKEA Latvia reserves the right to: (a) terminate, alter or amend the conditions of operation of the IKEA Family benefits at any time by announcing that on the website/ app; and (c) on reasonable grounds withdraw or cancel IKEA Family benefits.

11. If you do not agree with these terms of IKEA Family Account, do not create an Account and purchase goods as a Guest user.

12. The IKEA Family benefits are not transferable and can only be used by the Account holder.

13. This part III describes the rules of remote purchase and sale of goods (“Rules”) applicable to you when you conclude a remote purchase on our website and app. 

14. DEFINITIONS:

14.1. The Seller – IKEA Latvia – Paul Mason Properties SIA, as described above.

14.2. The Buyer – person purchasing goods and services at the Store or using the Store. The Buyer/Consumer shall be a natural person at least 18 years old, who plans to purchase goods or services from IKEA Latvia for personal family or household needs, for purposes unrelated to business or occupation. The Buyer/Entrepreneur shall be a natural or legal person, who plans to purchase goods or services from IKEA Latvia for business or occupation-related purposes. The Buyer, who is a legal person, shall act through his authorized representative registered at the Store in accordance with the established procedure.

14.3. The Store – an electronic IKEA Latvia store accessible online at www.ikea.com/lv/en/ or app IKEA.

14.4. Purchase and Sale Agreement – agreement on the purchase and sale of goods concluded by the Buyer and the Seller in accordance with these T&C.

14.5. Goods Hand-out Department – points of issue (pick-up) of goods owned by IKEA Latvia and located at:

14.5.1. Biķeru Street 2, Ulbroka, Stopiņu Parish, Ropaži Municipality, LV-1079 Republic of Latvia.

14.5.2. Ezermalas Street 3C, Liepaja, LV-3401, Latvia, Republic of Latvia.

14.6. The Goods hereinafter in the Rules shall cover both the goods and the services, unless explicitly stated or where the context indicates otherwise.

15. GENERAL PROVISIONS

15.1. The Buyer may purchase goods and services at the Store only having accepted the Rules. After the Buyer confirms having read the Rules, he/she undertakes to comply therewith and to execute them. By purchasing goods and services at the Store, the Buyer agrees with the application of the Rules and confirms that he/she has understood them. If the Buyer does not read and/or understand the Rules or does not agree with them, he/she cannot purchase goods and services at the Store.

15.2. Goods shall be sold at the Store from the territory of the Republic of Latvia.

15.3. The term “goods” used hereinafter in the Rules shall cover both goods and services, unless explicitly stated, or the context dictates otherwise.

16. ENTERING INTO THE PURCHASE AND SALE AGREEMENT

16.1. These T&C are the basis for concluding and executing one-time purchase and sale agreements. Upon concluding the Purchase and Sale Agreement for specific goods in accordance with the procedure established by the Rules, the terms and conditions of the Rules shall become the terms and conditions of the Purchase and Sale Agreement for such goods.

16.2. In order to purchase goods, the Buyer shall place an order at the Store by completing an electronic order form and then submitting it to the Seller.

16.3. The Purchase and Sale Agreement shall be considered concluded by the Buyer and the Seller after the Buyer, having accepted the T&C, submits his/her order for the goods and makes the corresponding payment. If the order is not paid, the agreement is not considered concluded.

16.4. The Purchase and Sale Agreement shall be valid until the obligations are fully fulfilled. The Purchase and Sale Agreement shall be considered fulfilled after the goods are handed over to the Buyer in accordance with the procedure laid down in the Rules and the laws of the Republic of Latvia.

16.5. By concluding the Purchase and Sale Agreement, the Buyer undertakes to pay the price of the goods and accept the goods ordered in the Store. Having paid for the order, the Buyer cannot add more items to that order. To order additional goods, the Buyer shall place a new order with the Seller.

17. RIGHTS AND OBLIGATIONS OF THE BUYER

17.1. The Buyer shall have the right:

17.1.1. to buy at the Store in accordance with the Rules, other instructions of the Seller, and legal acts of the Republic of Latvia;

17.1.2. the Buyer/consumer shall have the right to refuse the Purchase and Sale Agreement concluded at the Store by notifying the Seller thereof in writing no later than within 14 (fourteen) days in accordance with the procedure laid down in the Latvian Civil Law and the Rules;

17.1.3. to ask the Seller to repair or replace any defective and/or improperly assembled goods, to reduce the price of defective and/or improperly assembled goods proportionally, or to terminate the Purchase and Sale Agreement and accept the goods back, to enable the Buyer to benefit from the warranties applicable to the goods;

17.1.4. other rights provided for by Rules and/or legal acts of the Republic of Latvia.

17.2. The Buyer shall undertake:

17.2.1. to pay the price of ordered goods and their delivery, also to make other payments (if specified when entering into the Agreement) and to accept the goods ordered;

17.2.2. to inspect and to check goods when accepting them, also to inform the Seller about any damage of parcel, obvious defects of goods, or any incompliance of model or assembly of goods with those ordered by the Buyer in accordance with the procedure established by the Rules;

17.2.3. to check the quality of the purchased goods and to inform the Seller (by phone: +371 63301000 or e-mail:  [email protected]) about any quality defects of the goods that could not be noticed when handing over the goods;

17.2.4. having chosen to pick-up goods at the Goods Hands-out Department, to pick them up in due time;

17.2.5. having chosen the delivery service or other services offered by the Seller, to create conditions for their provision, also to properly pay for such services;

17.2.6. to pay the costs of returning the goods, if in accordance with the procedure established by legal acts such costs are to be borne by the Buyer;

17.2.7. to immediately update information, if the Buyer Account registration data or the delivery address information has changed;

17.2.8. not to use the Store in an illegal manner, including but not limited to ways that could lead to compromising proper functioning, security, and integrity of the Store or restricting the possibility of other persons to access the Store;

17.2.9. to comply with other requirements specified in other Rules and legal acts of the Republic of Latvia.

18. RIGHTS AND OBLIGATIONS OF THE SELLER

18.1. The Seller shall have the right:

18.1.1. to cancel the Buyer’s registration, if the Buyer violates the essential Rules, in particular - if his/her actions or inaction poses threat or causes damage to the Seller, other Buyers, or the third persons, also to the stability or safety of the Store;

18.1.2. to restrict or prohibit wholesale purchases;

18.1.3. to terminate the operation of the Store temporarily or altogether, to modify the Store or its separate parts, all and any of its contents, to change the website address of the Store activity and/or, depending on the technical capabilities of the Store system, to limit the number of registered Buyers; however, this shall not affect the Purchase and Sale Agreements concluded by the Buyer prior to the Seller’s decision to perform such actions, or the implementation thereof;

18.1.4. to change the Rules, the prices of goods, purchase terms and conditions and/or any other Store-related instructions, publishing such changes at the Store; however, such changes shall not affect the Purchase and Sale Agreements concluded by the Buyer prior to the Seller’s decision to perform such actions, or the implementation thereof.

19. PRICES OF GOODS AND PAYMENT FOR GOODS

19.1. The prices of the goods in the Store and/or the order are indicated in euros with the included value added tax.

19.2. The goods are sold to the Buyer at the prices valid in the Store at the time of placing the order. The specific price of the goods and the amount payable for the goods shall be visible to the Buyer after the shopping cart has been formed. If the Buyer disagrees with the specified price, he/she shall not be able to continue with ordering goods and placing the order.

19.3. The price of goods shall not include the price of delivery of goods and the price of services, which the Buyer may order additionally from the Seller. Unless expressly specified otherwise, the service of delivery of goods and other services shall be paid. The prices of such services and the procedure for their calculation and payment shall be specified at the Store.

19.4. A shopping cart with a total value of less than € 100 (including the VAT in force at the time) for all the goods of the relevant Seller is subject to an order click & collect fee of € 3.99 (including the VAT in force at the time). By approving the Rules, the Buyer agrees with the procedure of application of the order click & collect fee specified in this paragraph and shall pay it to the Seller. If, in the cases provided for in the Rules, the money for the goods is returned to the Buyer, the paid order click & collect fee shall also be refunded. Order click & collect fee does not apply if the Buyer has ordered a home delivery service from the Seller.

19.5. Purchase documents such as order information and VAT invoices shall be presented to the Buyer in a durable medium electronically in the Buyer’s Account, which the Buyer can use to download and/or print them out. Such electronic purchase documents are valid without the signature of the Seller and/or the Buyer.

20. DELIVERY OF GOODS

20.1. Goods shall be delivered in Latvia only. The possible methods of delivery of goods shall be presented to the Buyer after he/she forms his/her shopping cart and enters his/her delivery address.

20.2. Delivery of goods shall be a paid service. The delivery service prices are available here. The information contained in the link is considered an integral part of these Rules.

20.3. Where the Buyer chooses a delivery service, the delivery price shall be displayed to the Buyer at the end of the ordering process, before choosing the payment method and/or making the payment. The price of delivery of goods shall be paid in advance, along with the payment for goods.

20.4. Delivery service shall include;

20.4.1. if the goods shall be delivered to the apartment and the building does not have an elevator – the paid price of delivery of goods shall cover carriage of goods up to the 5th floor of the building. Additional fee in amount of EUR 3 (three euro) per each next (higher) floor shall be applied.

20.4.2. if the goods shall be delivered to the apartment and the building has an elevator – the paid price of delivery of goods shall cover carriage of goods using the elevator up to the floor specified by the Buyer.

20.4.3. if goods shall be delivered to the private house, the paid price of delivery of goods shall cover carriage of goods at the first floor of the private house.

20.5. When ordering a delivery service, the Buyer shall specify the exact delivery address and create suitable conditions for unloading the goods (unlock the entrance, lift a boom barrier, open the door, etc.). Delivered goods shall be carried through the door only; a balcony or windows may not be used to deliver goods.

20.6. In case of delivery of goods to the Buyer, the goods shall be unloaded at the place indicated by the Buyer. If the goods need to be moved or carried to a place other than the place of unloading indicated by the Buyer, the Buyer shall take care of such moving or carriage of goods by him/herself. If more than one order is delivered at a time, all items are unloaded in one location, and orders are not grouped. The delivery service provider has a right to refuse delivery if goods have to be carried further than 50 m and unloading and delivery conditions are not suitable. If so, the delivery service provider has a right to take photos, if necessary, also video recordings, to prove the facts (unsuitable conditions, environment etc.).

20.7. The Buyer must provide suitable conditions to the delivery service provider's employees for the unloading of goods (gates, barriers, doors are open, access to the delivery and unloading location is not harmful to one’s health or life, i.e., area is properly illuminated, road is clean and clear of any obstacles, non-slippery, etc.).

20.8. Before concluding the Purchase and Sale Agreement, the Buyer shall be informed in advance about the delivery time of the specific goods. The delivery time details shall be indicated in the last step of the order process, and the Seller shall deliver the goods to the Buyer within the time interval indicated. The Buyer may be additionally informed about the exact delivery date and time interval by e-mail and/or telephone.

20.9. The Buyer must be reachable via the phone provided in the order and present at the delivery address. If the Buyer fails to let the Seller’s representative in at the address of unloading of goods specified in the Buyer’s order at the agreed time of delivery and 10 (ten) minutes after this time, the goods shall be considered undelivered due to the Buyer’s fault. In such a case, goods ordered by the Buyer shall be returned to the warehouse, and the Seller’s representative shall agree with the Buyer on the nearest delivery date possible. The Buyer shall pay for redelivery. The goods shall be stored in the warehouse until the nearest delivery time, but not longer than the deadline specified in point 21.3 of the Rules. After the deadline has passed, the Buyer’s order shall be cancelled in accordance with the procedure set out in point 21.5 of the Rules.

20.10. Each order delivery is processed separately; combining multiple orders into a single delivery is not possible. The maximum size of one order shall be 500 kg or 6 m3. If the weight or volume of the goods ordered is greater than that, the delivery fee shall be respectively higher (e.g. in case of order of 501 kg or more, delivery fee for two orders shall be charged). Delivery of live plants and food items shall not be possible.

20.11. The Buyer must inform the Seller about any changes in the delivery time, cancellation and other important terms that were not communicated upon delivery processing at least 24 (twenty - four) hours ahead of the planned delivery time. Changing the delivery time is possible only once and it must be scheduled within 14 (fourteen) days from the original delivery date, otherwise it is necessary to arrange and pay for the new delivery or pay a storage fee EUR 10 (ten euro) per day.

20.12. When accepting goods, the Buyer shall check the condition of the parcel. In case of any visible damage to the packaging of the parcel, the Buyer shall mark this in the delivery confirmation form or the forms presented to him/her by the delivery person. In such a case goods shall be considered delivered in damaged packaging, but the delivery of goods shall be considered as carried out properly.

20.13. If there is a discrepancy between the intended and actual quality and/or range of goods, the Buyer shall not accept such goods. The Buyer shall state his/her refusal to accept the goods and mark the discrepancies detected in the delivery confirmation form and/or fill in the forms presented to him/her by the delivery person. Should any discrepancy in quantity of the goods be determined, the Buyer shall also indicate this in the parcel delivery confirmation form and/or complete the forms presented to him/her by the delivery person.

20.14. If the Buyer accepts the parcel without making any comments, the goods shall be considered delivered in an undamaged packaging. In the event that any defects in the goods not caused by the fault of the Buyer become apparent later, the Buyer shall maintain the right to benefit from the statutory 2-year quality warranty for the goods, as specified in Chapter 22 of these Rules. In addition to the statutory warranty for the goods, the Seller has the right to apply the commercial guarantee for certain goods, as set out in point 22.3 of these Rules.

20.15. The Buyer, who at the time of ordering the goods has chosen the option to pick up goods him/herself, shall also accept the goods from the Seller him/herself. When handing over the goods, the Buyer may be asked to provide an identity document and/or the information regarding the order sent to him/her by the Seller.

20.16. In the event that the Buyer has chosen to have the goods delivered by the Seller, the delivery of the goods to the address specified by the Buyer shall mean the goods have been handed over to the Buyer, regardless of whether the goods were actually accepted by the Buyer or any other person who has accepted the goods at the address specified. If the Buyer cannot accept the delivered goods him/herself, and the goods were delivered to the specified address, the Buyer shall not have the right to file any claims with the Seller regarding the delivery of goods to the wrong person. If the goods are not delivered on the planned delivery date due to the fault of the Buyer (e.g., the Buyer or another person is not present at the place of delivery at the agreed time), the Buyer shall inform the Seller thereof immediately, but not later than the day following the planned day of delivery of the goods, and the Buyer shall agree with the Seller on a new delivery time. In such case the Buyer shall pay for redelivery. The goods shall be stored in the warehouse until the nearest delivery time, but not longer than the deadline specified in point 21.3 of the Rules. After the deadline has passed, the Buyer’s order shall be cancelled in accordance with the procedure set out in point 21.5 of the Rules.

20.17. The Seller shall be released from liability for violation of terms of delivery of goods, if goods were not delivered to the Buyer or if they were not delivered in time due to the fault of the Buyer or for circumstances within the Buyer’s control.

21. PICK UP, STORAGE, AND WAREHOUSING OF GOODS

21.1. If the Buyer does not order the goods delivery service, he/she can pick up the ordered goods free of charge at the Goods Hands-out Department. When placing an order, the Buyer shall select which Goods Hands-out Department he/she wants to pick up the ordered goods at.

21.2. When goods are prepared for pick-up, the Buyer shall receive a confirmation message about the possibility to pick them up. The Buyer having arrived to pick up his/her goods at the Goods Hands-out Department shall have with him/herself and present to the Seller’s representative a valid identity document and order information and/or confirmation message sent to him/her by the Seller by means of electronic communication. If the Buyer fails to provide such documents, the Seller shall have the right to refuse to issue the goods to the Buyer.

21.3. The Buyer shall pick up the ordered goods no later than within 3 (three) days after the Seller has informed the Buyer by means of electronic communication that the goods are ready for pick-up.

21.4. After the Buyer picks up the goods, they shall be considered to have been handed over (delivered) to the Buyer.

21.5. If the Buyer fails to pick up his/her goods within the term specified in point 21.3 of the Rules, the order shall be cancelled, the present Purchase and Sale Agreement shall be terminated, and the money that the Buyer has paid for the goods, excluding the delivery fee if applicable, shall be returned by the Seller within 5 (five) working days. 

22. QUALITY OF GOODS, GUARANTEES

22.1. General properties of goods being sold shall be provided in the product description of each item. If the characteristics or properties of goods indicated in the product name or its description differ or contradict each other, the information presented in the product description shall be considered correct.

22.2. The Buyer shall be informed that due to the characteristics of electronic devices used by the Buyer, the technical parameters of the electronic devices (e.g. screen resolution of the device used by the Buyer, etc.), or other technical reasons or reasons beyond the Seller’s control the goods visible in the screen of the Buyer’s electronic device may not fully reflect the actual characteristics (such as shades of colour) of the goods as specified in the Store, as regards minor discrepancies in the appearance of the goods.

22.3. Goods purchased by the Buyers (consumers) shall be covered by the statutory 2 (two) years product quality warranty. The Seller shall also have a right to apply a commercial guarantee for certain products. 22.4. Goods purchased by Buyers/Entrepreneurs shall be subject to the guarantee specified at the Store. The guarantee period and other conditions shall be specified in product descriptions.

22.5. If the Buyer purchases a defective product, he/she shall have the right to:

22.5.1. ask for the product to be fixed (repaired); or

22.5.2. ask for the product to be replaced, unless such a request would not be possible or the Seller would incur disproportionate costs compared to the fulfilment of another request, taking into account all the circumstances, including the value of the product (if not defective), the significance of the defect of the product, and the assessment of whether the application of such a requirement would not cause any inconvenience to the Buyer; or

22.5.3. in accordance with the conditions set forth in point 22.10 of the Rules, to exercise the right to demand a proportional reduction of the price of the product or to terminate the Purchase and Sale Agreement.

22.6. In order to benefit from points 22.5.1 or 22.5.2 of the Rules, the Buyer shall return the product to the Seller for repair or replacement. When returning defective goods to the Seller, the Buyer shall provide the Seller with documents confirming the purchase of the goods (receipt or other document confirming the purchase). The cost of returning the product shall be borne by the Seller. If the product has been properly put in place (installed or mounted) prior to the discovery of the defect, depending on the nature and purpose of that product, the Seller’s obligation to repair or replace the product shall include the removal of the product and putting in place of the repaired or replaced product, or compensation of the removal and installation costs.

22.7. Before returning or replacing defective goods, as well as in cases where quality goods are returned not due to the refusal of the agreement, the Buyer (consumer) shall contact the Seller by telephone or e-mail specified (tel.: +371 63301000, e-mail: [email protected]) and agree on the conditions for the return or replacement of goods. The Buyer (consumer) may also return defective goods to the Customer Support and Returns Department. If the Buyer (consumer) wants to exchange a defective product and delivers it to the Customer Support and Returns Department outside Riga, that product shall be replaced within the term specified by the Seller, which is usually not longer than the time required to deliver the product that has to be replaced to the Goods Hands-out Department.

22.8. The Seller shall ensure that the repair or replacement of defective goods is carried out under the following conditions: 

22.8.1. free of charge - without charging for expenses related to the repair or replacement of the product, including the expenses of postage, transport, labour or materials;

22.8.2. within a reasonable time from the moment the Buyer has informed the Seller of the defective quality;

22.8.3. without causing significant inconvenience to the Buyer, taking into account the nature and purpose of the goods with respect to the Buyer.

22.9. The Seller shall have the right to refuse to ensure the appropriate quality of a defective product if that product cannot be repaired or replaced or if this would result in disproportionate costs, taking into account all the circumstances, including the value of the product (if not defective) and the significance of the defect of the product.

22.10. The Buyer shall have the right to demand a proportional reduction of the price of the product or to terminate the Purchase and Sale Agreement if:

22.10.1. the Seller has not repaired or replaced the product or has not carried out the repair or replacement in accordance with the requirements set forth in point 22.8 of the Rules, or the Seller has refused to ensure the appropriate quality of the product in accordance with point 22.9 of these Rules;

22.10.2. the defect occurred even though the Seller tried to eliminate the defect in the product;

22.10.3. the defect is substantial;

22.10.4. the Seller has stated or the circumstances show that the Seller will not ensure the appropriate quality of the product within a reasonable time, or this will cause significant inconvenience to the Buyer.

22.11. The Buyer shall exercise his right to terminate the Purchase and Sale Agreement by submitting to the Seller a statement expressing his/her decision to terminate the Purchase and Sale Agreement.

22.12. Upon termination of the Purchase and Sale Agreement by the Buyer:

22.12.1. the Buyer shall return the product to the Seller at the Seller’s expense;

22.12.2. the Seller, having received the returned product or the proof provided by the Buyer that the product has been sent out, shall refund the amount paid for that product to the Buyer within no more than 14 (fourteen) days.

22.12.3. the Buyer shall have no right to terminate the Purchase and Sale Agreement if the defect is minor.

22.13. In case the Buyer wants to use the possibility of reducing the price of a defective product, the price reduction shall be made in proportion to the decrease in the value of the product received by the Buyer, as compared to the value the product would have if there were no defects. 

22.14. In order to exercise his/her rights as set out in point 22.5 of the Rules, the Buyer shall notify the Seller of the non-compliance of the product with the quality requirements no later than within 2 (two) months from the date of detection of the non-compliance.

23. RIGHT OF WITHDRAWAL, RETURN OF GOODS

23.1. The Buyer (consumer) shall have the right to withdraw from the Purchase and Sale Agreement concluded by means of electronic communication without giving a reason therefor within 14 (fourteen) days from the date of delivery (receipt) of goods, or - if the Buyer (consumer) has ordered more than one product in a single order and those products are delivered separately - from the day of delivery (date of receipt) of the last product, or - if goods are delivered in different batches or in parts - from the date of delivery (date of receipt) of the last batch or part, except for the cases mentioned in point 22 of the Cabinet of Ministers Regulation No.255 "Regulations Regarding Distance Contracts", adopted on 20 May 2014.  The Buyer may withdraw from the Agreement by returning the product to the Customer Support and Returns Department or by means of electronic communication (e.g. by e-mail) by sending a notice of withdrawal to the Seller by e-mail: [email protected]. The Buyer’s notice shall clearly indicate the Buyer’s intention to withdraw from the Agreement. The Buyer shall also provide a purchase document (invoice, receipt, etc.) and present this document to the Customer Support and Returns Department or send its copy together with the notice of withdrawal of the Agreement, evidencing that the goods were purchased from the Seller. If the Buyer purchases several products under one Agreement, his/her right of withdrawal shall apply to both one or several products. Conditions laid down in points 23.2 to 23.13 below shall apply in cases where goods are returned by a Buyer who is a consumer.

23.2. Goods shall be returned to the Seller not later than within 14 (fourteen) calendar days from the day of sending out a withdrawal notice. The Buyer shall be responsible for properly packaging goods for return. The product shall be considered to be properly packaged when it is placed in an additional outer packaging (placed in a box or bag, wrapped in paper, etc.) and this packaging is tightly closed (for example, taped). The Buyer shall bear the direct costs of returning the goods, unless the Seller indicates to the Buyer after receiving the notice of withdrawal that they bear the costs of returning the goods themselves.

23.3. The goods shall be either returned to the Customer Support and Returns Department, or the Buyer may return them through the intermediaries (couriers) of his choice who shall deliver the goods to the Customer Support and Returns Department. Before returning the goods through intermediaries (couriers), the Buyer shall contact the Seller by phone or e-mail specified (tel.: +371 63301000, e-mail: [email protected]) and agree on the return of goods.

23.4. Money for the goods returned, including the amount paid by the Buyer for delivery, shall be returned to the Buyer after the goods are returned to the Seller or after the Buyer provides proof to the Seller that the goods have been sent to the Seller. If only a part of the purchased goods is returned, the Buyer shall be reimbursed for the cost of delivery of the goods proportionally to the ratio of the returned goods to the non-returned goods. The Buyer shall be refunded in the same manner as he/she purchased the goods (e.g. if the goods were paid for by bank transfer, the refund money shall be transferred to the Buyer’s bank account from which the payment was received), unless the Buyer agrees to another method of refund offered by the Seller.

23.5. The Seller shall not be considered to have violated the refund conditions if he is unable to make a transfer due to the fault of the Buyer (delayed return of goods, inaccurate data, etc.).

23.6. In any of the return options, the Seller shall not be obliged to reimburse the Buyer for the additional costs incurred due to the reason of him/her choosing a method other than the cheapest usual delivery method offered by the Seller.

23.7. In cases other than the withdrawal from the Agreement, for example, when the Buyer does not like the shape, size, colour, model or assembly combination of the goods, he/she may return the goods in accordance with the procedure established by the Rules and the legal acts of the Republic of Latvia. Certain Goods, such as Goods without packaging that are not suitable for return due to health or hygiene reasons, as well as services provided accordingly, cannot be returned. The list of said Goods is included in the Cabinet of Ministers Regulation No.255 "Regulations Regarding Distance Contracts", adopted on 20 May 2014.

23.8. Having purchased goods of poor quality, the Buyer shall have the right to exercise the rights provided for in point 22.5 of the Rules.

23.9. The Buyer shall act in accordance with the following conditions when returning the goods:

23.9.1. the goods returned shall be in their original packaging or in another orderly package;

23.9.2. the goods returned shall not be damaged by the Buyer;

23.9.3. the goods returned shall be unused and retain their commercial appearance (undamaged labels, unremoved protective films, etc.);

23.9.4. the goods returned shall come in the same assembly as received by the Buyer;

23.9.5. when returning goods, the Buyer shall present a VAT invoice evidencing their purchase and complete an application for the return of goods.

23.10. The Parties agree that if quality goods returned do not meet the conditions for returning the goods set out in point 23.9 of the Rules, the Seller, upon acceptance of the goods, also has the right to demand from the Buyer to reimburse the Seller a proportionate amount for the decrease in the value of the goods caused by the Buyer’s actions that were not necessary to determine the nature, characteristics, and operation of the goods.

23.11. The Seller shall also provide an additional 90-day return guarantee (365-day return guarantee for IKEA Family members), the conditions whereof available online at www.ikea.com/lv/en/customer-service/returns-claims/90-day-return-policy. In cases where the Buyer returns goods on the grounds of an additional 90-day return guarantee (365-day return guarantee for IKEA Family members) as applied by the Seller, the Buyer shall contact the Seller by phone or e-mail specified (tel.: +371 63301000, e-mail:  [email protected]) and agree on the conditions for the return or replacement of goods. In the event that the 14-day return period (i.e. the right of withdrawal) set forth in point 23.1 of the Rules has already expired and the Buyer wishes to benefit from an additional 90-day return guarantee, he/she shall bear the cost of delivery and return of the goods. The Buyer shall return the goods to the Customer Support and Returns Department.

23.12. The Buyer cannot return goods that cannot be returned in accordance with legal acts of the Republic of Latvia.

23.13. In case of provision of services of poor quality, the Buyer shall have the right to request to eliminate deficiencies in the provision of services, to refund the money paid for the services, or to reduce the price of the services.

23.14. Buyers/Entrepreneurs shall return and exchange goods in accordance with the return policy approved by the Seller: www.ikea.com/lv/en/customer-service/returns-claims/90-day-return-policy. Before returning the goods, Buyers/Entrepreneurs shall contact the Seller in accordance with point 23.11 of the Rules.

24. DISCOUNTS AND PROMOTIONS

24.1. The Seller may initiate various promotions or apply discounts at the Store at its own initiative. Discounts and promotions at the Store shall not have to necessarily be the same as those applied in the physical store of the Seller.

24.2. Detailed information related to discounts or promotions is provided in the Store at the time of performing a specific promotion or applying discounts.

24.3. When the Buyer purchases goods for which the Seller offers a certain discount or a gift and then takes advantage of his/her right to return goods, the Buyer shall be refunded only the amount of money that he/she has actually paid for the goods.

24.4. The Seller shall have the right to unilaterally, without a separate notice, change conditions of promotions or discounts, or to cancel them altogether. Any changes or cancellations in the procedure of application of promotions or discounts shall be valid from the moment of their publication and shall not apply to the previously concluded Purchase and Sale Agreements with the Buyer and their execution.

25. LIABILITY OF THE PARTIES

25.1. The Buyer shall be liable for transferring the registration data to third parties. If a third person uses the services provided by the Store or purchases goods or services at the Store having logged in to the Store using the Buyer’s login data, the Seller shall consider this person the Buyer, and the Buyer shall be liable for all the obligations arising therefrom.

25.2. The Seller shall be exempted from any liability in cases where losses arise due to the fact that the Buyer failed to read the Rules and/or the Purchase and Sale Agreement despite the Seller’s recommendation and own obligation to do so, even though such a possibility had been provided.

25.3. In the event that the unlawful actions of the Seller have caused damage to the Buyer who is a consumer, the Seller shall indemnify all losses incurred by that Buyer. If due to the Seller’s unlawful actions damage has been done to the Buyer who is not considered a consumer, the Seller shall indemnify only the direct losses incurred by that Buyer.

25.4. The Seller shall not be liable for non-performance of the Purchase and Sale Agreement and/or failure to deliver goods or late delivery of goods, where this occurred due to the fault of third parties or due to circumstances that the Seller could not control or reasonably foresee at the time of conclusion of the Purchase and Sale Agreement, and could not prevent the occurrence of such circumstances or their consequences (force majeure). Where the said circumstances last longer than 1 (one) month, the Parties may terminate the Purchase and Sale Agreement by their mutual agreement.

26. PROVISION OF INFORMATION

26.1. The Seller shall send all messages and other information to the Buyer to his/her specified e-mail address. This information shall be considered received by the Buyer within 3 (three) hours from the moment of it sending out.

26.2. The Seller shall not be liable for any malfunctions in the Internet connection or disruptions in networks of e-mail service providers due to which the Buyer is unable to receive e-mails from the Seller.

26.3. The Buyer shall send all notices, claims, applications, and questions using the contacts specified in these Rules, or the contact details indicated under the Contacts section of the Store.

27. FINAL PROVISIONS

27.1. All information provided on the Seller’s website, including, but not limited to these T&C, information about the Seller, offered goods and services, and their properties, procedure of implementation of the Buyer’s right to withdraw from the Purchase and Sale Agreement, as well as the maintenance services provided by the Seller and guarantees (if provided) shall be deemed to have been submitted to the Buyer in writing.

27.2. The Rules and the Purchase and Sale Agreement concluded by the Buyer and the Seller shall be subject to law of the Republic of Latvia.

27.3. The Seller may at any time assign its rights and obligations arising out of these Rules to any third persons without obtaining the Buyer’s consent thereto or notifying him/her thereof, however, ensuring that in case of transfer of rights and obligations of the Seller to third persons, the position of the Buyer does not deteriorate and the scope of rights and obligations remains unchanged.

27.4. All the disagreements between the Buyer and the Seller regarding the Rules shall be solved by negotiations. If the Parties fail to resolve disputes by negotiations within 15 (fifteen) days, disputes shall be finally settled in accordance with the procedure established by laws of the Republic of Latvia.

27.5. The Buyer (consumer) may submit requests and/or complaints regarding goods or services purchased at the Store with the State Consumer Rights Protection Centre (address Riga, tel.: +371 65452554, e-mail: [email protected], website: www.ptac.gov.lv). The latter condition does not apply to Buyers/Entrepreneurs.
