FOOD Mobile Terms and Conditions

1. Applicability of the FOOD Mobile General Terms and Conditions

1.1 These General Terms and Conditions apply to the FOOD Mobile service provided by IKEA Deutschland GmbH & Co. KG (“IKEA”).

1.2 FOOD Mobile is the online application provided by IKEA for ordering selected FOOD products from the Swedish Bistros or restaurants, with subsequent collection from the Swedish Bistro or restaurant at the relevant IKEA store.

1.3 FOOD products are selected open or unpackaged dishes, as well as drinks offered as part of a set menu alongside the dishes at the Swedish Bistro or restaurant of the relevant IKEA store.

1.4 The FOOD Mobile offer does not apply to products in the IKEA Swedish Shop and cannot be combined with the purchase of other products or services in the IKEA online shop.

 

2. Contractual partner

Your contractual partner for orders placed via FOOD Mobile is IKEA Deutschland GmbH & Co. 3. Conclusion of contract, ordering process and payment

3.1 Via FOOD Mobile, you can order and pay online for selected open or unpackaged food items and drinks offered as part of a set menu from the Swedish bistros or restaurants in our furniture stores prior to collection.

3.2 The offers in FOOD Mobile constitute a non-binding invitation to purchase FOOD products at IKEA. By ordering the FOOD products via the ‘Buy now’ button, you are making a binding offer to purchase the FOOD products in your basket. IKEA will inform you immediately by email that your order has been received and will also confirm the conclusion of the contract in the same email.

3.3 The prices quoted are in euros and include VAT. Payment is made during the ordering process via PayPal or by credit card.3.4 You will receive the invoice by email once the contract has been concluded and payment has been made.

 

4. Collection

4.1 Collection is exclusively by self-collection from the Swedish Bistro or restaurant at the relevant IKEA store.

4.2 The collection of ordered and paid-for FOOD products must take place by the end of the order day at the relevant Swedish Bistro or restaurant. Please note its opening and serving times.

4.3 When collecting your order, you must present the order confirmation with the order number, which will be sent to you after you have placed your order.

 

5. Cancellation

5.1 You have the option to cancel your order for FOOD products on the day you place it. In this case, we will refund the amount paid in cash, by credit card (MC, Visa, AMEX) or Girocard.

5.2 Cancellations must be made in person at the Schwedenbistro or restaurant in the relevant IKEA store.

 

6. No right of withdrawal

There is no statutory right of withdrawal for orders of FOOD products via FOOD Mobile, as these are goods that are liable to deteriorate rapidly or whose expiry date would be exceeded rapidly.

 

7. Contract text

IKEA does not store the contract text for you, and it will no longer be available to you once the contract has been concluded. However, upon conclusion of the contract, you have the option to access and save the contract terms, including the FOOD Mobile Terms and Conditions.

 

8. Applicable law/place of jurisdiction

The law of the Federal Republic of Germany applies exclusively. The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply. The exclusive place of jurisdiction between traders and IKEA is Munich.9. Consumer dispute resolutionIKEA is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board in accordance with the Consumer Dispute Resolution Act (VSGB).
