IKEA STORE ONLINE GENERAL TERMS AND CONDITIONS
DISCLAIMER

This document regulates the general terms and conditions for the use the Online Store to which you have just accede for purposes of creation and consult and purchase of products (hereinafter "Online Store") sold by IKEA PORTUGAL - MÓVEIS E DECORAÇÃO, LDA., company number 505416654, with registered offices at at Estrada Nacional 250, Rua 28 de Setembro, Frielas 2600-001 Loures, Portugal (hereinafter "IKEA").


I. IKEA Store Online / Data Processing / Privacy Policy
The use of this Online Store grants you the condition of Customer and entails your acceptance, full and without any reservations, of all the provisions of the General Conditions of Use as well as the Privacy Policy, in effect whenever you access Online Store
If you do not fully accept any of the conditions set out herein, you should not access/use the Online Store. By browsing, using or downloading content from the Online Store, you undertake to comply the terms set out in this document and in the Privacy Policy.
IKEA reserves the right to change the General Conditions without prior notice.
Data processing carried out by IKEA complies with the current legislation on personal data, specifically with Law No. 67/89, of 26 October, and where applicable is duly notified to the National Data Protection Commission. For more detailed information, please refer to the Privacy Policy.
All the information provided by the Customer must be truthful. The Customer agrees to update the information provided to IKEA, whenever it changes. The Customer expressly takes responsibility for any false or imprecise statements he/she/it provides and for the damages they cause to IKEA or to a third party, through the information he/she/it provides.
IKEA is the entity responsible for processing personal data, for the purposes of the execution of this contract.
In case these Terms and Conditions are breached, IKEA reserves the right to exercise any and all legal action. IKEA also reserves the right, in its sole discretion, to block the Customer access or use of the Online Store, with or without notifying the Customer.
The Customer is aware that the use of Online Store may not be 100% safe and that there is a possibility that the information sent/received may be tampered with by unauthorised parties, for which IKEA shall not be held responsible.
The contractual proposal included in IKEA Store Online is only directed at people of sufficient legal age and the Customer accepts that it may only be used by people of age of maturity with full contractual capacity and who can therefore be held responsible for the commitments resulting from purchase and sale.


II. Access to the Online Store

1. Online Purchasing Procedure
Step 1 – Select the items to add to your shopping cart(all prices shown are displayed in Euros and include VAT at the legal applicable rate)
The Customer hereby explicitly agrees and acknowledges that:

  • The pictures presented in the Online Store are for illustration purposes only, and the Customer should carefully and fully read the product information on the items essential characteristics that are described. If you have any questions, call the Contact Centre or visit an IKEA Store to get any additional information or details.
  • IKEA will make every reasonable effort to include an accurate and up-to-date description of the products on the IKEA website.
  • The price of the items displayed in the Online Store corresponds to the full amount to be paid by the Customer and is completely independent of any potential price fluctuations made by IKEA at its stores.

Step 2 - Registration / Filling out the Form
To confirm their order using the Microsite, the Customer will have to fill out a form, in which he/she/it shall indicate:

  • Full name or trade name of the Customer;
  • The Customer's telephone numbers and email addresses;
  • Customer's taxpayer number;
  • Store of his/her/its choice for collection;
  • Preferred collection date;
  • Full name of the person who will collect the purchased items;
  • Full name or trade name of the Customer for invoicing purposes;
  • Customer’s taxpayer number for invoicing purposes;
  • Customer address for invoicing purposes.

The Customer ensures that the information provided when filling in the forms is true and accurate, and is liable for any damage caused to IKEA resulting from the data inaccuracy.
The Customer is required to report to IKEA, in writing, any change to the personal data provided during the term of this contract.

The Customer undertakes to carefully check the information in his/her/its order summary, confirming the products and services added to the shopping cart, the Customer details and the invoicing details. At this point, the Customer should go back to the previous steps to correct any incorrect information he/she/it detects.
Payment method: Mastercard or Visa credit card. Data to be collected: credit card number, expiry date, csv code.
After completing the previous steps and confirming acceptance of these General Conditions, the Customer may then click the order confirmation button. IKEA then confirms that it has received the order to the email address provided by the Customer.
As soon as IKEA confirms payment has been made, the respective invoice will be sent with the items subject to the sale and purchase when they are collected.
Any subsequent changes to the current conditions are not binding for the Customer. The Customer should print out a copy of these general conditions for future reference as the contracts are not filed by IKEA. This contract shall be concluded in Portuguese language.

  • Full name or trade name of the Customer for invoicing purposes;
  • Customer taxpayer number for invoicing purposes;
  • Customer address for invoicing purposes;
  • Home delivery is made to an apartment or house;
  • Potential delivery restrictions;
  • Delivery floor;
  • If the building has an adequate lift for the ordered items.

The Customer ensures that the information provided when filling in the forms is true and accurate, and is liable for any damage caused to IKEA resulting from the data inaccuracy.
The Customer is required to report to IKEA, in writing, any change to the personal data provided during the term of this contract.

Step 3 - Confirmation of the products and services added to the shopping cart, Buyer Information and Invoicing and Payment Information
The Customer must carefully check the information in his/her/it order summary, confirming the products and services added to the shopping cart, the Customer details and the invoicing details. At this point, the Customer should go back to the previous steps to correct any incorrect information.

After completing the previous steps and confirming acceptance of these General Conditions, the Customer may then click the order confirmation button. IKEA then confirms that it has received the order to the email address provided by the Customer.

2. Delivery Terms
Delivery of the Items / Transportation
In case of unavailability of any items, IKEA will shall notify the Customer within a maximum period of 30 (thirty) days from the moment this unavailability is identified and will provide the Customer with a full refund, if both Parties are unable to reach an agreement on a new date for the agreement’s execution.
If the Customer is not available to receive the delivery on the agreed date and time, they should contact IKEA to suggest a new date, to occur within a maximum period of 7 (seven) days from the first delivery date. Otherwise, the Customer will have to pay an additional fee for the items’ storage, charged at €14 (fourteen euros)/week.
The Customer undertakes to appear at the delivery agreed place and time to receive the merchandise. If the delivery does not occur due to a failure from the Customer's, the second delivery will be taken on by them, at the applicable transportation fee.
The Customer explicitly accepts and acknowledges that he/she/it should specify on the "Delivery Information" form if it is necessary to use lifting gear to deliver the items at the requested location. If the presented budget for the use of lifting gear is not accepted by the Customer and/or if the delivery cannot be carried out for that reason, the Customer will have to:
(i) confirm that they want the items to be left outside the delivery address given, and the contract shall then be considered fully complied by IKEA, or
(ii) confirm that they want to terminate the purchase and sale agreement, in which case the Customer is responsible for paying all transportation fees for shipping and collection of the goods from the delivery address to the origin warehouse, at the current transportation fees. In this case, the Customer also agrees and acknowledges that IKEA will refund the goods by deducting the amount for transportation and collection within a maximum period of 14 (fourteen) days from that date. Under no circumstances shall IKEA be held liable for any other amounts. The Customer, or their representative, shall examine the products upon delivery.
Customers are further informed that lifting, extra helpers, staff hours or any other extra resources needed are not included in the transportation fee and will be subject to variable quotation on a case by case basis.
If the Customer finds the products to be damaged and/or if the products do not match with his/her/its order request, the Customer should record the damage or defects on the sheet intended for that purpose. The Customer should also call IKEA through its Contact Centre at 800 20 30 20 (Monday to Saturday: 09:00-22:00; Sunday and holidays: 09:00-20:00. - toll-free call, in the 2 days following the delivery date.
Cancellation of the Transport / Delivery Services

If the Customer cancels the Delivery Services on the same day they are hired, more than 24 hours prior to the delivery date, IKEA will only refund the amount of €10.15 (ten euros and fifteen cents) for the delivery services of the amount paid by the Customer.

If the Customer cancels the Delivery Services on the same day they are hired, less than 24 hours prior to the delivery date, the value of the service will not be refunded.

These costs are not applicable in the event of Acts of God or force majeure, provided they are duly proven by the Customer.



III. Guarantees
IKEA shall be liable under the terms and conditions set out in Decree-Law No. 67/2003, of 8 April (as changed by Decree-Law No. 84/2008 of 21 May), for any lack of conformity that exists upon delivery of the products and appears within two years from the delivery date, provided it is communicated to IKEA within a maximum period of 2 months from the date on which it has been detected. Additionally, and notwithstanding the guarantee set out in the law, IKEA offers so-called voluntary guarantees that extend the guarantee period, on selected products.


IV. Termination of the Contract
If the Customer has not received his/her/its order, he/she/it has the right to Freely Terminate the Contract, which must be requested by sending an email to: lojaonline@ikea.com. In this case, the value of the goods will be refunded, with the exception of €20 concerning collection and transportation costs when they are related to the order.
In line with the provisions of article 10 of Decree-Law No. 24/2014, of 14 February (in its current wording), the Customer has the right to freely terminate the contract, without the need to give a reason, up to 14 (fourteen) days from the delivery of the goods. In this case, the Customer agrees to pay all charges for transportation and collection of the goods between the delivery address and the origin warehouse at the transportation fees currently in effect, available at: http://www.ikea.com/ms/en_PT/customer-service/about-shopping/comprar-online/index.html#tarifa. In this case, the Customer also agrees and acknowledges that IKEA will refund the goods by deducting the amount for transportation and collection within a maximum period of 14 (fourteen) days from that date. Under no circumstances shall IKEA be held liable for any other amounts. The Customer, or their representative, shall examine the products condition upon delivery.
For the exercise of this right, the Customer shall send an email to lojaonline@ikea.com within the given deadline, about their decision to terminate the contract, in which case IKEA shall confirm the termination also by email.
Either of the Parties may also terminate the contract for failure to comply with the obligations set forth in these General Conditions.


V. Exchanges and Returns
You have a period of 365 days to return or exchange your purchase. All you have to do is bring the unused items to an IKEA store along with the original invoice. Refunds will be made by crediting a card or to the same payment method. Custom made PERSONLIG counter tops and products from the Recovery/Bargain corner are subject to specific terms. VI. Complaints
The Customer may report any complaints to IKEA through the Contact Centre line at 800 20 30 20 (Monday to Saturday: 09:00-22:00; Sunday and holidays: 09:00-20:00. - toll-free call) and by post mail to be sent to the following address: IKEA Portugal, EN 250, Rua 28 de Setembro, Frielas, 2660-001 Loures, Portugal.


VII. Applicable Law and Jurisdiction
Any disputes between the Parties arising out of or in connection with this contract shall be settled by the Portuguese law. Any issue or litigation resulting from the enforcement, interpretation, integration or execution of this Contract, when it cannot be settled by the Parties, shall be submitted to the Portuguese courts. Consumer Rights information may be obtained by resorting to Alternative Dispute Resolution Entities available at www.consumidor.pt. It is not IKEA's policy to be involved in arbitration provided by those entities and we will assess, on a case by case basis, the best alternative for settling the dispute, while taking consumer rights into account.


The Customer declares to understand and accept in full and without reservation these terms and conditions.
